46 AN ACT
57 relating to developing a strategic plan for the improvement and
68 expansion of high-quality bilingual education.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter B, Chapter 29, Education Code, is
911 amended by adding Section 29.067 to read as follows:
1012 Sec. 29.067. STRATEGIC PLAN TO IMPROVE AND EXPAND BILINGUAL
1113 EDUCATION. (a) In this section, "general academic teaching
1214 institution" has the meaning assigned by Section 61.003.
1315 (b) The agency, in collaboration with the Texas Higher
1416 Education Coordinating Board and the Texas Workforce Commission,
1517 shall develop a strategic plan that sets tangible goals and
1618 establishes timelines to:
1719 (1) increase the number of educators certified under
1820 Subchapter B, Chapter 21, in bilingual education instruction;
1921 (2) increase the number of dual language
2022 immersion/one-way and two-way program models used in public
2123 schools;
2224 (3) educate families and school district employees
2325 regarding the importance of bilingual education in early childhood;
2426 (4) adopt a uniform process for:
2527 (A) identifying students in prekindergarten
2628 through 12th grade of limited English proficiency;
2729 (B) monitoring the bilingual learning of
2830 students in prekindergarten through 12th grade; and
2931 (C) collecting data regarding the identification
3032 and monitoring under Paragraphs (A) and (B); and
3133 (5) increase the number of bilingual and multilingual
3234 high school graduates.
3335 (c) In developing the strategic plan, the agency:
3436 (1) shall consult with appropriate representatives
3537 of:
3638 (A) general academic teaching institutions;
3739 (B) public schools;
3840 (C) early childhood education programs; and
3941 (D) parents and legal guardians of public school
4042 students;
4143 (2) may collaborate with representatives of:
4244 (A) state, regional, and local agencies;
4345 (B) nonprofit organizations;
4446 (C) social services providers;
4547 (D) faith-based organizations; and
4648 (E) the business community; and
4749 (3) shall study the use of the Bilingual Target
4850 Language Proficiency Test to certify educators in bilingual
4951 education instruction and:
5052 (A) determine:
5153 (i) the impact of using that test to assess
5254 the critical competencies necessary to instruct bilingual programs
5355 at each grade level; and
5456 (ii) if any barriers to the certification
5557 of bilingual educators exist based on differences between the
5658 dialect of the educator and the dialect used on the test; and
5759 (B) make recommendations to modify or revise the
5860 assessments used to certify educators in bilingual education
5961 instruction to enhance the competency of educators serving
6062 bilingual programs.
6163 (d) The agency shall submit the plan developed under this
6264 section to the governor, the lieutenant governor, the speaker of
6365 the house of representatives, and each member of the standing
6466 committees of the senate and house of representatives having
6567 primary jurisdiction over public education not later than December
6668 1, 2022.
6769 (e) This section expires January 1, 2023.
6870 SECTION 2. This Act takes effect immediately if it receives
6971 a vote of two-thirds of all the members elected to each house, as
7072 provided by Section 39, Article III, Texas Constitution. If this
7173 Act does not receive the vote necessary for immediate effect, this
7274 Act takes effect September 1, 2021.
