| 7 | 7 | | relating to the sale of certain personal information from driver's |

| 8 | 8 | | license records maintained by the Department of Public Safety. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 521.050(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) In addition to the provisions of this subchapter |
|---|
| 13 | 13 | | relating to the disclosure of driver's license information on an |
|---|
| 14 | 14 | | individual, the department may provide a purchaser, in a format |
|---|
| 15 | 15 | | prescribed by the department and acceptable to the purchaser, the |
|---|
| 16 | 16 | | names, addresses, and dates of birth of all license holders that are |
|---|
| 17 | 17 | | contained in the department's basic driver's license record file if |
|---|
| 18 | 18 | | the purchaser certifies in writing that the purchaser: |
|---|
| 19 | 19 | | (1) is eligible to receive the information under |
|---|
| 20 | 20 | | Chapter 730; and |
|---|
| 21 | 21 | | (2) has not experienced a breach of system security, |
|---|
| 22 | 22 | | as defined by Section 521.053, Business & Commerce Code, in the |
|---|
| 23 | 23 | | previous five years. |

| 24 | 24 | | SECTION 2. Section 521.050, Transportation Code, as amended |
|---|
| 25 | 25 | | by this Act, applies only to the disclosure by the Department of |
|---|
| 26 | 26 | | Public Safety of driver's license information in response to a |
|---|
| 27 | 27 | | request for the information that is made on or after the effective |
|---|
| 28 | 28 | | date of this Act. The disclosure by the Department of Public Safety |
|---|
| 29 | 29 | | of driver's license information in response to a request for the |
|---|
| 30 | 30 | | information that is made before the effective date of this Act is |
|---|
| 31 | 31 | | governed by the law in effect immediately before the effective date |
|---|
| 32 | 32 | | of this Act, and the former law is continued in effect for that |
|---|
| 33 | 33 | | purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2021. |
