| 7 | 7 | | relating to the classification of certain exotic livestock and |
|---|
| 8 | 8 | | exotic and nongame animals. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 161.001(a)(4), Agriculture Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (4) "Exotic livestock" means grass-eating or |
|---|
| 13 | 13 | | plant-eating, single-hooved or cloven-hooved mammals that are not |
|---|
| 14 | 14 | | indigenous to this state and are known as ungulates, including |
|---|
| 15 | 15 | | animals from the swine, horse, tapir, rhinoceros, elephant, deer, |
|---|
| 16 | 16 | | and antelope families. The term does not include elk. |
|---|
| 17 | 17 | | SECTION 2. Section 43.103(3), Parks and Wildlife Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (3) "Exotic animals" includes exotic livestock and |
|---|
| 20 | 20 | | exotic fowl as defined by Section 161.001(a), Agriculture Code, |
|---|
| 21 | 21 | | wild animals that are nonindigenous to Texas, and aoudad sheep. The |
|---|
| 22 | 22 | | term does not include [, and] elk. |
|---|
| 23 | 23 | | SECTION 3. Section 62.015(a), Parks and Wildlife Code, is |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (a) In this section, "exotic animal" means exotic livestock |
|---|
| 26 | 26 | | or exotic fowl as defined by Section 161.001(a), Agriculture Code, |
|---|
| 27 | 27 | | or aoudad sheep. The term does not include [, or] elk. |

| 28 | 28 | | SECTION 4. Section 67.0011, Parks and Wildlife Code, is |
|---|
| 29 | 29 | | amended to read as follows: |
|---|
| 30 | 30 | | Sec. 67.0011. EXEMPTIONS [EXEMPTION OF CRAYFISH]. This |
|---|
| 31 | 31 | | chapter does not apply to: |
|---|
| 32 | 32 | | (1) crayfish, other than in public water; or |
|---|
| 33 | 33 | | (2) elk. |
|---|
| 34 | 34 | | SECTION 5. The changes in law made by this Act apply only to |
|---|
| 35 | 35 | | an offense committed on or after the effective date of this Act. An |
|---|
| 36 | 36 | | offense committed before the effective date of this Act is covered |
|---|
| 37 | 37 | | by the law in effect when the offense was committed, and the former |
|---|
| 38 | 38 | | law is continued in effect for that purpose. For purposes of this |
|---|
| 39 | 39 | | section, an offense was committed before the effective date of this |
|---|
| 40 | 40 | | Act if any element of the offense was committed before that date. |
|---|
| 41 | 41 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2021. |
