55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the classification of certain exotic livestock and
88 exotic and nongame animals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.001(a)(4), Agriculture Code, is
1111 amended to read as follows:
1212 (4) "Exotic livestock" means grass-eating or
1313 plant-eating, single-hooved or cloven-hooved mammals that are not
1414 indigenous to this state and are known as ungulates, including
1515 animals from the swine, horse, tapir, rhinoceros, elephant, deer,
1616 and antelope families. The term does not include elk.
1717 SECTION 2. Section 43.103(3), Parks and Wildlife Code, is
1818 amended to read as follows:
1919 (3) "Exotic animals" includes exotic livestock and
2020 exotic fowl as defined by Section 161.001(a), Agriculture Code,
2121 wild animals that are nonindigenous to Texas, and aoudad sheep. The
2222 term does not include [, and] elk.
2323 SECTION 3. Section 62.015(a), Parks and Wildlife Code, is
2424 amended to read as follows:
2525 (a) In this section, "exotic animal" means exotic livestock
2626 or exotic fowl as defined by Section 161.001(a), Agriculture Code,
2727 or aoudad sheep. The term does not include [, or] elk.
2828 SECTION 4. Section 67.0011, Parks and Wildlife Code, is
2929 amended to read as follows:
3030 Sec. 67.0011. EXEMPTIONS [EXEMPTION OF CRAYFISH]. This
3131 chapter does not apply to:
3232 (1) crayfish, other than in public water; or
3333 (2) elk.
3434 SECTION 5. The changes in law made by this Act apply only to
3535 an offense committed on or after the effective date of this Act. An
3636 offense committed before the effective date of this Act is covered
3737 by the law in effect when the offense was committed, and the former
3838 law is continued in effect for that purpose. For purposes of this
3939 section, an offense was committed before the effective date of this
4040 Act if any element of the offense was committed before that date.
4141 SECTION 6. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2021.
