55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to use of project funds of municipal development
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 377.072(c), Local Government Code, is
1111 amended to read as follows:
1212 (c) Except as provided by Subsections (d) and (e), the
1313 district may use money in the development project fund only to:
1414 (1) pay the costs of planning, acquiring,
1515 establishing, developing, constructing, or renovating one or more
1616 development projects located:
1717 (A) in the district; or
1818 (B) outside the district, if:
1919 (i) the board determines that the
2020 development project will provide an economic benefit to the
2121 district; and
2222 (ii) the following entities, as applicable,
2323 by resolution approve the development project:
2424 (a) the municipality that created the
2525 district;
2626 (b) each municipality in whose
2727 corporate limits or extraterritorial jurisdiction the project is
2828 located; and
2929 (c) the commissioners court of the
3030 county in which the project is located, if the project is not
3131 located in the corporate limits or extraterritorial jurisdiction of
3232 a municipality;
3333 (2) pay the principal of, interest on, and other costs
3434 relating to bonds or other obligations issued by the district or to
3535 refund bonds or other obligations; or
3636 (3) pay the costs of operating or maintaining one or
3737 more development projects during the planning, acquisition,
3838 establishment, development, construction, or renovation or while
3939 bonds or other obligations for the planning, acquisition,
4040 establishment, development, construction, or renovation are
4141 outstanding.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2021.
