55 AN ACT
66 relating to confirmation of a voter's residence by a voter
77 registrar.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.051(a), Election Code, is amended to
1010 read as follows:
1111 (a) If the registrar receives notice under Section 13.146,
1212 14.023, 15.053, 16.0921, or 18.0681(d) or otherwise has reason to
1313 believe that a voter's current residence is different from that
1414 indicated on the registration records, the registrar shall deliver
1515 to the voter a written confirmation notice requesting confirmation
1616 of the voter's current residence.
1717 SECTION 2. Subchapter C, Chapter 15, Election Code, is
1818 amended by adding Section 15.054 to read as follows:
1919 Sec. 15.054. CONFIRMATION NOTICE AFTER EVIDENCE OF CHANGE
2020 OF RESIDENCE. (a) At least annually the registrar shall:
2121 (1) request from the United States Postal Service any
2222 available information, including information from the National
2323 Change of Address database, indicating address reclassifications
2424 or changes of address affecting the registered voters of the
2525 county; and
2626 (2) for each voter in the county who fails to vote in
2727 any election, submit an application for a ballot to be voted by mail
2828 under Chapter 84 or 101, or submit a change in voter registration
2929 under Chapter 13 or 15 for two years from the date of a general
3030 election for state and county officers, examine real property sales
3131 and other public records to determine whether the voter changed
3232 residence to a location outside of the county.
3333 (b) If information obtained under Subsection (a) gives the
3434 registrar reason to believe a voter has changed the voter's
3535 residence to a location outside of the county, the registrar shall
3636 deliver a confirmation notice to the voter in accordance with
3737 Section 15.051.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2021.
