9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 103, Occupations Code, is amended by | |
11 | 11 | adding Section 103.005 to read as follows: | |
12 | 12 | Sec. 103.005. REQUIRED NOTICE. A hospital or health care | |
13 | 13 | facility shall provide written notice to each physician, nurse, | |
14 | 14 | staff member, or employee of the hospital or facility that: | |
15 | 15 | (1) the individual has a right to object to directly or | |
16 | 16 | indirectly performing or participating in an abortion procedure; | |
17 | 17 | (2) the hospital or facility is prohibited from | |
18 | 18 | discriminating against the individual for refusing to perform or | |
19 | 19 | participate in an abortion procedure; and | |
20 | 20 | (3) the individual may be entitled to a remedy, | |
21 | 21 | including injunctive relief, affirmative relief, and any other | |
22 | 22 | necessary relief, under Section 103.003 for a violation of the | |
23 | 23 | individual's right to object. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
