44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to notice of the right to object to participation in an
77 abortion procedure for health care personnel of a hospital or
88 health care facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 103, Occupations Code, is amended by
1111 adding Section 103.005 to read as follows:
1212 Sec. 103.005. REQUIRED NOTICE. A hospital or health care
1313 facility shall provide written notice to each physician, nurse,
1414 staff member, or employee of the hospital or facility that:
1515 (1) the individual has a right to object to directly or
1616 indirectly performing or participating in an abortion procedure;
1717 (2) the hospital or facility is prohibited from
1818 discriminating against the individual for refusing to perform or
1919 participate in an abortion procedure; and
2020 (3) the individual may be entitled to a remedy,
2121 including injunctive relief, affirmative relief, and any other
2222 necessary relief, under Section 103.003 for a violation of the
2323 individual's right to object.
2424 SECTION 2. This Act takes effect September 1, 2021.
