|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 1, Chapter 341, Acts of the 55th |
|---|
| 12 | 12 | | Legislature, Regular Session, 1957, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 1. The creation and organization of the Brushy Creek |
|---|
| 14 | 14 | | Water Control and Improvement District No. 1 of Williamson and |
|---|
| 15 | 15 | | Milam Counties[, hereinafter referred to as "District,"] is hereby |
|---|
| 16 | 16 | | in all things validated. Without limiting the generalization of the |
|---|
| 17 | 17 | | foregoing, it is specifically provided that the order adopted by |
|---|
| 18 | 18 | | the State Board of Water Engineers of Texas on the first day of |
|---|
| 19 | 19 | | November, 1956, creating said District; the election held within |
|---|
| 20 | 20 | | said District on the eighth day of January, 1957, for the |
|---|
| 21 | 21 | | confirmation of the organization of said District, the election of |
|---|
| 22 | 22 | | directors, and for the issuance of preliminary bonds and levy of |
|---|
| 23 | 23 | | taxes in payment therefor, and all proceedings in connection with |
|---|
| 24 | 24 | | the order and said election are in all respects validated and when |
|---|
| 25 | 25 | | said preliminary bonds have been issued and delivered to the |
|---|
| 26 | 26 | | purchaser or purchasers thereof, they shall be incontestable. |

| 27 | 27 | | SECTION 2. Chapter 341, Acts of the 55th Legislature, |
|---|
| 28 | 28 | | Regular Session, 1957, is amended by adding Sections 1A and 8A to |
|---|
| 29 | 29 | | read as follows: |
|---|
| 30 | 30 | | Sec. 1A. In this chapter, "district" means the Upper Brushy |
|---|
| 31 | 31 | | Creek Water Control and Improvement District and the Lower Brushy |
|---|
| 32 | 32 | | Creek Water Control and Improvement District. |
|---|
| 33 | 33 | | Sec. 8A. The Upper Brushy Creek Water Control and |
|---|
| 34 | 34 | | Improvement District is not required to comply with municipal |
|---|
| 35 | 35 | | regulations regarding the construction, maintenance, |
|---|
| 36 | 36 | | rehabilitation, or removal of dams. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2021. |
