59 relating to the creation and activities of the Texas Produced Water
610 Consortium.
711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
812 SECTION 1. Chapter 109, Education Code, is amended by
913 adding Subchapter E to read as follows:
1014 SUBCHAPTER E. TEXAS PRODUCED WATER CONSORTIUM
1115 Sec. 109.201. DEFINITIONS. In this subchapter:
1216 (1) "Agency advisory council" means the agency
1317 advisory council created under Section 109.202.
1418 (2) "Consortium" means the Texas Produced Water
1519 Consortium.
1620 (3) "Fluid oil and gas waste" has the meaning assigned
1721 by Section 122.001, Natural Resources Code.
1822 (4) "Host university" means Texas Tech University.
1923 (5) "Private entity" means an individual,
2024 corporation, or nonprofit corporation.
2125 (6) "Stakeholder advisory council" means the
2226 stakeholder advisory council created under Section 109.202.
2327 (7) "Technical and economic steering committee" means
2428 the technical and economic steering committee created under Section
2529 109.202.
2630 Sec. 109.202. TEXAS PRODUCED WATER CONSORTIUM. The Texas
2731 Produced Water Consortium is a consortium consisting of the host
2832 university, the agency advisory council, the stakeholder advisory
2933 council, the technical and economic steering committee, and private
3034 entities. The consortium is created to bring together information
3135 resources to study the economics of and technology related to, and
3236 the environmental and public health considerations for, beneficial
3337 uses of fluid oil and gas waste.
3438 Sec. 109.203. ADMINISTRATION. (a) The agency advisory
3539 council is composed of representatives of the:
3640 (1) Department of Agriculture;
3741 (2) General Land Office;
3842 (3) Parks and Wildlife Department;
3943 (4) Railroad Commission of Texas;
4044 (5) State Energy Conservation Office;
4145 (6) Texas Commission on Environmental Quality;
4246 (7) Texas Economic Development and Tourism Office
4347 within the office of the governor; and
4448 (8) Texas Water Development Board.
4549 (b) Each entity described by Subsection (a) shall select a
4650 representative to serve on the agency advisory council.
4751 (c) The agency advisory council shall meet as often as
4852 necessary to ensure the consortium meets the requirements of this
4953 subchapter.
5054 (d) The agency advisory council shall advise the consortium
5155 on matters related to the subject matter expertise of the agencies
5256 represented, including matters related to the regulation and
5357 permitting of and treatment standards for fluid oil and gas waste.
5458 Treatment standards may include a fit for purpose requirement and
5559 regulations necessary for the protection of public health and the
5660 environment.
5761 (e) The stakeholder advisory council is composed of
5862 representatives of:
5963 (1) the oil and gas industry;
6064 (2) agricultural water users;
6165 (3) industrial water users;
6266 (4) environmental interests;
6367 (5) fluid oil and gas waste recycling operators;
6468 (6) public water utilities;
6569 (7) landowners or owners of groundwater rights;
6670 (8) commercial water recyclers and midstream water
6771 companies; and
6872 (9) other appropriate interests or industries.
6973 (f) The host university shall appoint members to the
7074 stakeholder advisory council from members of the consortium. If no
7175 member of the consortium represents an interest or industry
7276 described by Subsection (e), the host university may appoint a
7377 person to represent the interest or industry from outside the
7478 consortium.
7579 (g) The stakeholder advisory council shall advise the
7680 consortium on matters related to research, investigation, and
7781 contract development.
7882 (h) The technical and economic steering committee is
7983 composed of members appointed by the host university to provide
8084 technical, economic, and scientific expertise. The technical and
8185 economic steering committee shall determine the feasibility of
8286 proposals for research or investigation by the consortium and
8387 decide which proposals the consortium will accept for research or
8488 investigation.
8589 Sec. 109.204. DUTIES. (a) The consortium shall study the
8690 economic, environmental, and public health considerations of
8791 beneficial uses of fluid oil and gas waste and technology needed for
8892 those uses. After October 1, 2022:
8993 (1) the research and investigation goals of the
9094 consortium shall be directed by the members of the consortium; and
9195 (2) the host university may disband the consortium if
9296 the host university determines that the consortium does not have
9397 sufficient membership.
9498 (a-1) This subsection expires October 1, 2022. Not later
9599 than September 1, 2022, the consortium shall produce a report that
96100 includes:
97101 (1) suggested changes to laws and administrative rules
98102 to better enable beneficial uses of fluid oil and gas waste,
99103 including specific changes designed to find and define beneficial
100104 uses for fluid oil and gas waste outside of the oil and gas
101105 industry;
102106 (2) suggested guidance for establishing fluid oil and
103107 gas waste permitting and testing standards;
104108 (3) a technologically and economically feasible pilot
105109 project for state participation in a facility designed and operated
106110 to recycle fluid oil and gas waste; and
107111 (4) an economic model for using fluid oil and gas waste
108112 in a way that is economical and efficient and that protects public
109113 health and the environment.
110114 (b) The host university shall:
111115 (1) provide staff and other resources necessary for
112116 the consortium to meet the requirements of this subchapter;
113117 (2) consult with the New Mexico Produced Water
114118 Research Consortium and that consortium's Government Advisory
115119 Board on research, data, and any other matter related to the
116120 consortium; and
117121 (3) solicit participation from:
118122 (A) the oil and gas industry;
119123 (B) agricultural water users;
120124 (C) industrial water users;
121125 (D) environmental interests;
122126 (E) fluid oil and gas waste recycling operators;
123127 (F) commercial water recyclers and midstream
124128 water companies;
125129 (G) landowners;
126130 (H) owners of groundwater rights;
127131 (I) public water utilities; and
128132 (J) river authorities subject to Section
129133 325.025, Government Code.
130134 (c) The host university shall coordinate with other members
131135 of the state university system and state agencies to provide
132136 resources necessary for the consortium to meet the requirements of
133137 this subchapter.
134138 Sec. 109.205. FUNDING. (a) The agency advisory council and
135139 the host university shall collaborate to create a fee structure
136140 that establishes membership costs at various levels for private
137141 entities that may contribute money to the consortium for research
138142 and investigation. Membership costs may include contributions of
139143 equipment or other resources in lieu of money.
140144 (b) Money paid by private entities as membership costs may
141145 be used only for research and investigation conducted by the
142146 consortium.
143147 (c) Except for state money appropriated to the host
144148 university for use in meeting the requirements of Section
145149 109.204(a-1) and resources provided by the host university and
146150 other state university system entities or state agencies, the
147151 consortium may not receive state money.
148152 (d) The consortium may accept gifts and grants of money,
149153 equipment, or other resources necessary to accomplish its duties
150154 under this subchapter.
151155 Sec. 109.206. ACCESS TO DATA. (a) In exchange for
152156 membership in the consortium, a private entity may receive access
153157 to data produced as a result of investigation by the consortium in
154158 an amount proportionate to the entity's level of membership.
155159 (b) A private entity's access to the consortium's
156160 investigation data must be governed by a membership contract
157161 between the host university and the entity that describes the data
158162 to be released to the private entity.
159163 (c) The consortium shall make information about the work of
160164 the consortium available to the public on an Internet website
161165 maintained by the host university. Information made available
162166 under this subsection may not be privileged, proprietary, or
163167 confidential.
164168 SECTION 2. (a) Not later than October 1, 2021, each state
165169 agency described by Section 109.203(a), Education Code, as added by
166170 this Act, shall select a representative to serve on the agency
167171 advisory council of the Texas Produced Water Consortium, as
168172 required by Section 109.203(b), Education Code, as added by this
169173 Act.
170174 (b) Not later than September 1, 2022, the Texas Produced
171175 Water Consortium shall deliver the report required by Section
172176 109.204(a-1), Education Code, as added by this Act.
173177 (c) Not later than September 1, 2022, the Texas Produced
174178 Water Consortium shall create a pilot project required by Section
175179 109.204(a-1)(3), Education Code, as added by this Act.
176180 SECTION 3. The Texas Produced Water Consortium, as created
177181 by Subchapter E, Chapter 109, Education Code, as added by this Act,
178182 is required to implement a provision of this Act only if the
179183 legislature appropriates money specifically for that purpose. If
180184 the legislature does not appropriate money specifically for that
181185 purpose, the consortium may, but is not required to, implement a
182186 provision of this Act using other appropriations available for that
183187 purpose.
184188 SECTION 4. This Act takes effect immediately if it receives
185189 a vote of two-thirds of all the members elected to each house, as
186190 provided by Section 39, Article III, Texas Constitution. If this
187191 Act does not receive the vote necessary for immediate effect, this
188192 Act takes effect September 1, 2021.
