66 AN ACT
77 relating to persons permitted to be in a polling place or a place
88 where ballots are being counted.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.001, Election Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) Except as permitted by this code and as described by
1414 Subsection (a-1), a person may not be in the polling place from the
1515 time the presiding judge arrives there on election day to make the
1616 preliminary arrangements until the precinct returns have been
1717 certified and the election records have been assembled for
1818 distribution following the election.
1919 (a-1) Under this code, a person may be lawfully present in a
2020 polling place during the time described by Subsection (a) if the
2121 person is:
2222 (1) an election judge or clerk;
2323 (2) a watcher;
2424 (3) a state or federal inspector;
2525 (4) a person admitted to vote;
2626 (5) a child under 18 years of age who is accompanying a
2727 parent who has been admitted to vote;
2828 (6) a person providing assistance to a voter under
2929 Section 61.032 or 64.032;
3030 (7) a special peace officer appointed by the presiding
3131 judge under Section 32.075;
3232 (8) the county chair of a political party conducting a
3333 primary election, as authorized by Section 172.1113;
3434 (9) a voting system technician, as authorized by
3535 Section 125.010; or
3636 (10) a person whose presence has been authorized by
3737 the presiding judge in accordance with this code.
3838 SECTION 2. Section 87.026, Election Code, is amended to
3939 read as follows:
4040 Sec. 87.026. BYSTANDERS EXCLUDED. (a) Except as permitted
4141 by this code and as described by Subsection (b), a person may not be
4242 in the meeting place of an early voting ballot board during the time
4343 of the board's operations.
4444 (b) Under this code, a person may be lawfully present in the
4545 meeting place of an early voting ballot board during the time of the
4646 board's operations if the person is:
4747 (1) a presiding judge or member of the board;
4848 (2) a watcher;
4949 (3) a voting system technician, as authorized by
5050 Section 125.010; or
5151 (4) a person whose presence has been authorized by the
5252 presiding judge in accordance with this code.
5353 SECTION 3. Subchapter A, Chapter 127, Election Code, is
5454 amended by adding Section 127.008 to read as follows:
5555 Sec. 127.008. BYSTANDERS EXCLUDED. (a) Except as permitted
5656 by this code and as described by Subsection (b), a person may not be
5757 in a central counting station while ballots are being counted.
5858 (b) Under this code, a person may be lawfully present in the
5959 central counting station while ballots are being counted if the
6060 person is:
6161 (1) a counting station manager, tabulation
6262 supervisor, assistant to the tabulation supervisor, presiding
6363 judge, or clerk;
6464 (2) a watcher;
6565 (3) a voting system technician, as authorized by
6666 Section 125.010; or
6767 (4) a person whose presence has been authorized by the
6868 counting station manager in accordance with this code.
6969 SECTION 4. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2021.
