| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 133.001(1), (3), (4), (5), and (6), |
|---|
| 11 | 11 | | Education Code, are amended to read as follows: |
|---|
| 12 | 12 | | (1) "Apprenticeship training program" means a |
|---|
| 13 | 13 | | training program that provides on-the-job training, preparatory |
|---|
| 14 | 14 | | instruction, supplementary instruction, or related instruction in |
|---|
| 15 | 15 | | a trade that has been certified as an apprenticeable |
|---|
| 16 | 16 | | [apprenticible] occupation by the Office of Apprenticeship [Bureau |
|---|
| 17 | 17 | | of Apprenticeship Training of the United States Department of |
|---|
| 18 | 18 | | Labor]. |
|---|
| 19 | 19 | | (3) "Supplementary instruction" means a course of |
|---|
| 20 | 20 | | instruction for persons employed as journeymen craftsmen in |
|---|
| 21 | 21 | | apprenticeable [apprenticible] trades that is designed to provide |
|---|
| 22 | 22 | | new skills or upgrade current skills. |
|---|
| 23 | 23 | | (4) "Related instruction" means organized, |
|---|
| 24 | 24 | | off-the-job instruction in theoretical or technical subjects |
|---|
| 25 | 25 | | required for the completion of an apprenticeship program for a |
|---|
| 26 | 26 | | particular apprenticeable [apprenticible] trade. |
|---|
| 27 | 27 | | (5) "Commission" means the Texas Workforce |
|---|
| 28 | 28 | | [Employment] Commission. |
|---|
| 29 | 29 | | (6) "Office of Apprenticeship" ["Bureau"] means the |
|---|
| 30 | 30 | | Office of Apprenticeship [Bureau of Apprenticeship Training] of the |
|---|
| 31 | 31 | | United States Department of Labor. |
|---|
| 32 | 32 | | SECTION 2. Sections 133.002(c), (d), (g), and (h), |
|---|
| 33 | 33 | | Education Code, are amended to read as follows: |
|---|
| 34 | 34 | | (c) A program must be under the direction of an |
|---|
| 35 | 35 | | apprenticeship committee whose members are appointed by one or more |
|---|
| 36 | 36 | | employers of apprentices, one or more bargaining agents |
|---|
| 37 | 37 | | representing members of an apprenticeable [apprenticible] trade, |
|---|
| 38 | 38 | | or a combination of the above, and the committee shall perform the |
|---|
| 39 | 39 | | duties set forth in Section 133.003. If an apprenticeship |
|---|
| 40 | 40 | | committee is composed of representatives of one or more employers |
|---|
| 41 | 41 | | and one or more bargaining agents, the number of committee members |
|---|
| 42 | 42 | | designated by the employer or employers shall be equal to the number |
|---|
| 43 | 43 | | of committee members designated by the bargaining agent or agents. |
|---|
| 44 | 44 | | (d) Each apprentice participating in a program must be given |
|---|
| 45 | 45 | | a written apprenticeship agreement by the apprenticeship committee |
|---|
| 46 | 46 | | stating the standards and conditions of the apprentice's employment |
|---|
| 47 | 47 | | and training. The standards must conform substantially with the |
|---|
| 48 | 48 | | standards of apprenticeship for the particular trade which have |
|---|
| 49 | 49 | | been adopted by the Office of Apprenticeship [bureau]. |
|---|
| 50 | 50 | | (g) An apprenticeship training program must provide |
|---|
| 51 | 51 | | adequate facilities, personnel, and resources to effectively |
|---|
| 52 | 52 | | administer the program in a manner consistent with the public's |
|---|
| 53 | 53 | | need for skilled craftsmen and the apprentices' need for marketable |
|---|
| 54 | 54 | | skills in apprenticeable [apprenticible] occupations. |
|---|
| 55 | 55 | | (h) A program must be registered with the Office of |
|---|
| 56 | 56 | | Apprenticeship [bureau] and approved by the commission. |
|---|
| 57 | 57 | | SECTION 3. Section 133.006(b), Education Code, is amended |
|---|
| 58 | 58 | | to read as follows: |
|---|
| 59 | 59 | | (b) At least annually, the [The] commission shall prepare |
|---|
| 60 | 60 | | and submit to the Texas Workforce Investment Council or to the |
|---|
| 61 | 61 | | Apprenticeship and Training Advisory Committee, as designated by |
|---|
| 62 | 62 | | the Texas Workforce Investment Council, a report that includes: |
|---|
| 63 | 63 | | (1) an apprenticeship-related instruction cost study |
|---|
| 64 | 64 | | for the most recent state fiscal year; and |
|---|
| 65 | 65 | | (2) the funding distribution for |
|---|
| 66 | 66 | | apprenticeship-related instruction programs for the state fiscal |
|---|
| 67 | 67 | | year in which the report is submitted [an update to the |
|---|
| 68 | 68 | | Apprenticeship Related Instruction Cost Study adopted by the State |
|---|
| 69 | 69 | | Board of Education on February 10, 1973, prior to each biennial |
|---|
| 70 | 70 | | session of the legislature]. |
|---|
| 71 | 71 | | SECTION 4. This Act takes effect September 1, 2021. |
