66 AN ACT
77 relating to the administration of apprenticeship training
88 programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 133.001(1), (3), (4), (5), and (6),
1111 Education Code, are amended to read as follows:
1212 (1) "Apprenticeship training program" means a
1313 training program that provides on-the-job training, preparatory
1414 instruction, supplementary instruction, or related instruction in
1515 a trade that has been certified as an apprenticeable
1616 [apprenticible] occupation by the Office of Apprenticeship [Bureau
1717 of Apprenticeship Training of the United States Department of
1818 Labor].
1919 (3) "Supplementary instruction" means a course of
2020 instruction for persons employed as journeymen craftsmen in
2121 apprenticeable [apprenticible] trades that is designed to provide
2222 new skills or upgrade current skills.
2323 (4) "Related instruction" means organized,
2424 off-the-job instruction in theoretical or technical subjects
2525 required for the completion of an apprenticeship program for a
2626 particular apprenticeable [apprenticible] trade.
2727 (5) "Commission" means the Texas Workforce
2828 [Employment] Commission.
2929 (6) "Office of Apprenticeship" ["Bureau"] means the
3030 Office of Apprenticeship [Bureau of Apprenticeship Training] of the
3131 United States Department of Labor.
3232 SECTION 2. Sections 133.002(c), (d), (g), and (h),
3333 Education Code, are amended to read as follows:
3434 (c) A program must be under the direction of an
3535 apprenticeship committee whose members are appointed by one or more
3636 employers of apprentices, one or more bargaining agents
3737 representing members of an apprenticeable [apprenticible] trade,
3838 or a combination of the above, and the committee shall perform the
3939 duties set forth in Section 133.003. If an apprenticeship
4040 committee is composed of representatives of one or more employers
4141 and one or more bargaining agents, the number of committee members
4242 designated by the employer or employers shall be equal to the number
4343 of committee members designated by the bargaining agent or agents.
4444 (d) Each apprentice participating in a program must be given
4545 a written apprenticeship agreement by the apprenticeship committee
4646 stating the standards and conditions of the apprentice's employment
4747 and training. The standards must conform substantially with the
4848 standards of apprenticeship for the particular trade which have
4949 been adopted by the Office of Apprenticeship [bureau].
5050 (g) An apprenticeship training program must provide
5151 adequate facilities, personnel, and resources to effectively
5252 administer the program in a manner consistent with the public's
5353 need for skilled craftsmen and the apprentices' need for marketable
5454 skills in apprenticeable [apprenticible] occupations.
5555 (h) A program must be registered with the Office of
5656 Apprenticeship [bureau] and approved by the commission.
5757 SECTION 3. Section 133.006(b), Education Code, is amended
5858 to read as follows:
5959 (b) At least annually, the [The] commission shall prepare
6060 and submit to the Texas Workforce Investment Council or to the
6161 Apprenticeship and Training Advisory Committee, as designated by
6262 the Texas Workforce Investment Council, a report that includes:
6363 (1) an apprenticeship-related instruction cost study
6464 for the most recent state fiscal year; and
6565 (2) the funding distribution for
6666 apprenticeship-related instruction programs for the state fiscal
6767 year in which the report is submitted [an update to the
6868 Apprenticeship Related Instruction Cost Study adopted by the State
6969 Board of Education on February 10, 1973, prior to each biennial
7070 session of the legislature].
7171 SECTION 4. This Act takes effect September 1, 2021.
