55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to carrying and storing a firearm or firearm ammunition by
88 a hotel guest.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter C, Chapter 2155,
1111 Occupations Code, is amended to read as follows:
1212 SUBCHAPTER C. FIREARMS POLICY [NOTICE]
1313 SECTION 2. Section 2155.101, Occupations Code, is amended
1414 to read as follows:
1515 Sec. 2155.101. DEFINITIONS [DEFINITION]. In this
1616 subchapter:
1717 (1) "Hotel" means a hotel, motel, inn, or similar
1818 business entity that offers more than 10 rooms to the public for
1919 temporary lodging for a fee [, "hotel" has the meaning assigned by
2020 Section 156.001, Tax Code].
2121 (2) "License holder" has the meaning assigned by
2222 Section 46.035, Penal Code.
2323 SECTION 3. Subchapter C, Chapter 2155, Occupations Code, is
2424 amended by adding Section 2155.1025 to read as follows:
2525 Sec. 2155.1025. FIREARMS POLICY. (a) Unless possession of
2626 a handgun or other firearm or ammunition on hotel property is
2727 prohibited by state or federal law, a hotel may not adopt a policy
2828 prohibiting a hotel guest who is a license holder from:
2929 (1) carrying or storing a firearm or firearm
3030 ammunition in the guest's hotel room;
3131 (2) carrying a firearm or firearm ammunition directly
3232 en route to or from the hotel or the guest's hotel room;
3333 (3) carrying a firearm or firearm ammunition directly
3434 en route to or from the guest's vehicle located on the hotel
3535 property, including a vehicle in a parking area provided for hotel
3636 guests; or
3737 (4) carrying or storing a firearm or firearm
3838 ammunition in the guest's vehicle located on the hotel property,
3939 including a vehicle in a parking area provided for hotel guests.
4040 (b) A hotel may adopt a policy requiring a hotel guest
4141 carrying a firearm or firearm ammunition in a common area on the
4242 hotel property to:
4343 (1) carry a handgun in a concealed manner; or
4444 (2) carry a firearm or ammunition in a case or bag.
4545 SECTION 4. Section 30.05, Penal Code, is amended by adding
4646 Subsection (f-4) to read as follows:
4747 (f-4) It is a defense to prosecution under this section
4848 that:
4949 (1) the conduct occurred on hotel property, and the
5050 basis on which entry on that property was forbidden is that entry
5151 with a firearm or firearm ammunition was forbidden;
5252 (2) the actor:
5353 (A) holds a license to carry a handgun under
5454 Subchapter H, Chapter 411, Government Code; and
5555 (B) is a guest of a hotel, as defined by Section
5656 2155.101, Occupations Code; and
5757 (3) the actor:
5858 (A) carries or stores a firearm or firearm
5959 ammunition in the actor's hotel room;
6060 (B) carries a firearm or firearm ammunition
6161 directly en route to or from the hotel or the actor's hotel room;
6262 (C) carries a firearm or firearm ammunition
6363 directly en route to or from the actor's vehicle located on the
6464 hotel property, including a vehicle in a parking area provided for
6565 hotel guests; or
6666 (D) carries or stores a firearm or firearm
6767 ammunition in the actor's vehicle located on the hotel property,
6868 including a vehicle in a parking area provided for hotel guests.
6969 SECTION 5. Section 30.06, Penal Code, is amended by adding
7070 Subsection (e-4) to read as follows:
7171 (e-4) It is a defense to prosecution under this section that
7272 the license holder is a guest of a hotel, as defined by Section
7373 2155.101, Occupations Code, and the license holder:
7474 (1) carries or stores a handgun in the license holder's
7575 hotel room;
7676 (2) carries a handgun directly en route to or from the
7777 hotel or the license holder's hotel room;
7878 (3) carries a handgun directly en route to or from the
7979 license holder's vehicle located on the hotel property, including a
8080 vehicle in a parking area provided for hotel guests; or
8181 (4) carries or stores a handgun in the license holder's
8282 vehicle located on the hotel property, including a vehicle in a
8383 parking area provided for hotel guests.
8484 SECTION 6. Section 30.07, Penal Code, is amended by adding
8585 Subsection (e-4) to read as follows:
8686 (e-4) It is a defense to prosecution under this section that
8787 the license holder is a guest of a hotel, as defined by Section
8888 2155.101, Occupations Code, and the license holder:
8989 (1) carries or stores a handgun in the license holder's
9090 hotel room;
9191 (2) carries a handgun directly en route to or from the
9292 hotel or the license holder's hotel room;
9393 (3) carries a handgun directly en route to or from the
9494 license holder's vehicle located on the hotel property, including a
9595 vehicle in a parking area provided for hotel guests; or
9696 (4) carries or stores a handgun in the license holder's
9797 vehicle located on the hotel property, including a vehicle in a
9898 parking area provided for hotel guests.
9999 SECTION 7. Sections 30.05, 30.06, and 30.07, Penal Code, as
100100 amended by this Act, apply only to an offense committed on or after
101101 the effective date of this Act. An offense committed before the
102102 effective date of this Act is governed by the law in effect on the
103103 date the offense was committed, and the former law is continued in
104104 effect for that purpose. For purposes of this section, an offense
105105 was committed before the effective date of this Act if any element
106106 of the offense occurred before that date.
107107 SECTION 8. This Act takes effect September 1, 2021.
