55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to procedures for peace officers and emergency medical
88 services personnel who respond to calls involving an alleged or
99 suspected act of strangulation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1212 amended by adding Article 2.33 to read as follows:
1313 Art. 2.33. PROCEDURES FOR RESPONDING TO CALLS INVOLVING
1414 ALLEGED OR SUSPECTED ACT OF STRANGULATION. (a) In this article:
1515 (1) "Emergency medical services personnel" has the
1616 meaning assigned by Section 773.003, Health and Safety Code.
1717 (2) "Strangulation" means impeding the normal
1818 breathing or circulation of the blood of a person by applying
1919 pressure to the person's throat or neck or by blocking the person's
2020 nose or mouth.
2121 (b) A peace officer who responds to a call for service that
2222 involves an alleged or suspected act of strangulation shall:
2323 (1) request assistance from emergency medical
2424 services personnel to evaluate and render aid to the victim of
2525 strangulation;
2626 (2) use the checklist developed under Section
2727 1701.165, Occupations Code, in providing appropriate assistance to
2828 the victim; and
2929 (3) provide the victim with referral information to
3030 the appropriate support agency for purposes of receiving additional
3131 assistance.
3232 (c) The peace officer's report regarding the incident must
3333 thoroughly document the following:
3434 (1) the name, identification number, employment
3535 agency, and unit number of all emergency medical services personnel
3636 providing assistance under Subsection (b);
3737 (2) victim and witness accounts of the suspect's
3838 behavior, actions, and any comments made during the act of
3939 strangulation;
4040 (3) the officer's observations regarding the suspect's
4141 behavior, actions, and any comments made after the officer's
4242 arrival on the scene; and
4343 (4) the referral information given to the victim under
4444 Subsection (b)(3).
4545 (d) Emergency medical services personnel providing
4646 assistance under Subsection (b) shall conduct a medical evaluation
4747 and assessment of the victim.
4848 SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is
4949 amended by adding Section 1701.165 to read as follows:
5050 Sec. 1701.165. CHECKLIST FOR PEACE OFFICERS RESPONDING TO
5151 CALLS INVOLVING ALLEGED OR SUSPECTED ACT OF STRANGULATION. (a) In
5252 this section, "strangulation" has the meaning assigned by Article
5353 2.33, Code of Criminal Procedure.
5454 (b) The commission shall develop and make available to all
5555 law enforcement agencies in this state a checklist to assist peace
5656 officers in evaluating an alleged or suspected act of strangulation
5757 and providing assistance to the victim of strangulation.
5858 SECTION 3. (a) Not later than December 1, 2021, the Texas
5959 Commission on Law Enforcement shall develop and make available the
6060 checklist required by Section 1701.165, Occupations Code, as added
6161 by this Act.
6262 (b) A peace officer is not required to comply with Article
6363 2.33(b)(2), Code of Criminal Procedure, as added by this Act, until
6464 January 1, 2022.
6565 SECTION 4. This Act takes effect September 1, 2021.
