| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 47.002(f), Parks and Wildlife Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (f) A person who takes or assists in taking oysters on a | |
| 14 | 14 | vessel licensed as a commercial oyster boat under Chapter 76 is | |
| 15 | 15 | [not] required to obtain or possess a general commercial | |
| 16 | 16 | fisherman's license unless the person holds a commercial oyster | |
| 17 | 17 | boat captain's license. | |
| 18 | 18 | SECTION 2. Section 76.101(d), Parks and Wildlife Code, is | |
| 19 | 19 | amended to read as follows: | |
| 20 | 20 | (d) Each member of the crew of a licensed commercial oyster | |
| 21 | 21 | boat is required to have a general commercial fisherman's license | |
| 22 | 22 | to take oysters while they are on a licensed boat that is being used | |
| 23 | 23 | to take oysters. This subsection does not apply to the captain of a | |
| 24 | 24 | licensed commercial oyster boat. | |
| 25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2021. |
