| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Sections 382.0216(f) and (h), Health and Safety | |
| 12 | 12 | Code, are repealed. | |
| 13 | 13 | SECTION 2. The change in law made by this Act applies only | |
| 14 | 14 | to an enforcement action initiated by the Texas Commission on | |
| 15 | 15 | Environmental Quality on or after the effective date of this Act. | |
| 16 | 16 | An enforcement action initiated before the effective date of this | |
| 17 | 17 | Act is governed by the law in effect immediately before the | |
| 18 | 18 | effective date of this Act, and the former law is continued in | |
| 19 | 19 | effect for that purpose. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2021. |
