77 relating to the development of a special education services matrix.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1010 amended by adding Section 29.0012 to read as follows:
1111 Sec. 29.0012. SPECIAL EDUCATION SERVICES MATRIX. (a) The
1212 commissioner shall develop and periodically update materials for
1313 use in evaluating the special education services provided to a
1414 student under this subchapter, including:
1515 (1) a special education services matrix that:
1616 (A) identifies categories for special education
1717 services;
1818 (B) assigns intensity levels for the services in
1919 each category; and
2020 (C) produces an aggregate score to assign to each
2121 student enrolled in a special education program under this
2222 subchapter based on the intensity level of services the student
2323 requires across the categories; and
2424 (2) a handbook for using the special education
2525 services matrix to assist school districts in determining the
2626 nature and intensity levels of the special education services
2727 provided to a student under this subchapter.
2828 (b) In developing the materials under Subsection (a), the
2929 commissioner shall:
3030 (1) review and adapt, as appropriate, special
3131 education services matrixes used by other states; and
3232 (2) consult with stakeholders, including:
3333 (A) public school finance experts;
3434 (B) directors of school district special
3535 education programs;
3636 (C) superintendents of school districts;
3737 (D) public school campus administrators;
3838 (E) teachers certified in special education;
3939 (F) teachers certified in general education;
4040 (G) providers of special services that are
4141 described as "related services" under Section 29.002(2);
4242 (H) representatives of advocacy organizations
4343 with an interest in special education;
4444 (I) parents of students receiving special
4545 education services under this subchapter; and
4646 (J) any other person or organization the
4747 commissioner considers appropriate.
4848 (c) The commissioner of education shall develop a proposal
4949 for a method of funding for special education services based on the
5050 special education matrix developed under Subsection (a). The
5151 proposal must include:
5252 (1) recommendations to the legislature for changes to
5353 the public school finance system necessary to transition the
5454 financing of special education services provided by school
5555 districts from the special education allotment under Section 49.102
5656 to an allotment based on the nature and intensity levels of the
5757 special education services provided by districts; and
5858 (2) a transition plan for implementing the
5959 recommendations under Subdivision (1), including a recommended
6060 timeline for implementation.
6161 (d) The commissioner shall confer with the Legislative
6262 Budget Board to develop the proposal under Subsection (c).
6363 (e) Not later than September 1, 2022, the commissioner shall
6464 submit written or electronic copies of the materials developed
6565 under Subsections (a) and (c) to the lieutenant governor, the
6666 speaker of the house of representatives, and the members of the
6767 standing legislative committees with primary jurisdiction over
6868 public education, and shall provide revised materials as soon as
6969 practicable after each periodic update of the materials.
7070 SECTION 2. This Act takes effect September 1, 2021.
