8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
10 | 10 | amended by adding Article 2.33 to read as follows: | |
11 | 11 | Art. 2.33. USE OF FORCE REPORTING. (a) In this article, | |
12 | 12 | "law enforcement agency" means an agency of the state or an agency | |
13 | 13 | of a political subdivision of the state authorized by law to employ | |
14 | 14 | peace officers. | |
15 | 15 | (b) Each law enforcement agency shall require each peace | |
16 | 16 | officer employed by the agency to submit a detailed report to the | |
17 | 17 | agency regarding each incident in which the officer uses force, or | |
18 | 18 | witnesses another officer use force, against a person suspected of | |
19 | 19 | committing an offense. | |
20 | 20 | (c) The report must include: | |
21 | 21 | (1) a description of the force used by the peace | |
22 | 22 | officer; | |
23 | 23 | (2) an explanation as to why the degree of force used | |
24 | 24 | was necessary; and | |
25 | 25 | (3) if applicable, a description of any attempt that | |
26 | 26 | was made by the peace officer to de-escalate the situation before | |
27 | 27 | the force was used. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2021. |
