55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to use of force reporting by peace officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1010 amended by adding Article 2.33 to read as follows:
1111 Art. 2.33. USE OF FORCE REPORTING. (a) In this article,
1212 "law enforcement agency" means an agency of the state or an agency
1313 of a political subdivision of the state authorized by law to employ
1414 peace officers.
1515 (b) Each law enforcement agency shall require each peace
1616 officer employed by the agency to submit a detailed report to the
1717 agency regarding each incident in which the officer uses force, or
1818 witnesses another officer use force, against a person suspected of
1919 committing an offense.
2020 (c) The report must include:
2121 (1) a description of the force used by the peace
2222 officer;
2323 (2) an explanation as to why the degree of force used
2424 was necessary; and
2525 (3) if applicable, a description of any attempt that
2626 was made by the peace officer to de-escalate the situation before
2727 the force was used.
2828 SECTION 2. This Act takes effect September 1, 2021.
