9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 2.33 to read as follows: | |
12 | 12 | Art. 2.33. LAW ENFORCEMENT POLICY ON USE OF FORCE BY PEACE | |
13 | 13 | OFFICERS. (a) In this article, "law enforcement agency" means an | |
14 | 14 | agency of the state or an agency of a political subdivision of the | |
15 | 15 | state authorized by law to employ peace officers. | |
16 | 16 | (b) Each law enforcement agency shall adopt a detailed | |
17 | 17 | written policy regarding the use of force by peace officers. The | |
18 | 18 | policy must provide peace officers employed by the agency with | |
19 | 19 | explicit guidelines for the use of force that ensure that force will | |
20 | 20 | only be used against a person in a manner proportionate to the | |
21 | 21 | threat posed by the person. | |
22 | 22 | SECTION 2. Not later than January 1, 2022, each law | |
23 | 23 | enforcement agency in this state shall adopt the policy required by | |
24 | 24 | Article 2.33, Code of Criminal Procedure, as added by this Act. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
