57 relating to the disclosure of appraisal reports in connection with
68 the use of eminent domain authority.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 21.0111, Property Code, is amended by
911 adding Subsection (a-1) to read as follows:
1012 (a-1) An entity seeking to acquire real property through the
1113 use of eminent domain shall, not later than the third business day
1214 before the date of a special commissioner's hearing, disclose to
1315 the property owner any and all current and existing appraisal
1416 reports produced or acquired by the entity relating specifically to
1517 the owner's property and used in determining the entity's opinion of
1618 value, if an appraisal report is to be used at the hearing.
1719 SECTION 2. The change in law made by this Act applies only
1820 to a condemnation proceeding commenced on or after the effective
1921 date of this Act.
2022 SECTION 3. This Act takes effect September 1, 2021.
