7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Section 21.0111, Property Code, is amended by |
---|
9 | 11 | | adding Subsection (a-1) to read as follows: |

10 | 12 | | (a-1) An entity seeking to acquire real property through the |
---|
11 | 13 | | use of eminent domain shall, not later than the third business day |
---|
12 | 14 | | before the date of a special commissioner's hearing, disclose to |
---|
13 | 15 | | the property owner any and all current and existing appraisal |
---|
14 | 16 | | reports produced or acquired by the entity relating specifically to |
---|
15 | 17 | | the owner's property and used in determining the entity's opinion of |
---|
16 | 18 | | value, if an appraisal report is to be used at the hearing. |
---|
17 | 19 | | SECTION 2. The change in law made by this Act applies only |
---|
18 | 20 | | to a condemnation proceeding commenced on or after the effective |
---|
19 | 21 | | date of this Act. |
---|
20 | 22 | | SECTION 3. This Act takes effect September 1, 2021. |
