55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the award of attorney's fees and other costs in an
88 eminent domain proceeding.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.047, Property Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) If the amount of damages awarded by the special
1313 commissioners is at least 20 percent greater than the amount of the
1414 condemnor's final offer made in accordance with Section 21.0113, or
1515 if the commissioners' award is appealed and a court awards damages
1616 in an amount that is at least 20 percent greater than the amount of
1717 the condemnor's final offer made in accordance with Section
1818 21.0113, the condemnor:
1919 (1) shall pay all costs as provided by Subsection (a);
2020 and
2121 (2) may be required to pay reasonable attorney's fees
2222 and other professional fees incurred by the property owner in
2323 connection with the eminent domain proceeding.
2424 SECTION 2. Section 21.047(a-1), Property Code, as added by
2525 this Act, applies only to an eminent domain proceeding commenced on
2626 or after the effective date of this Act. An eminent domain
2727 proceeding commenced before the effective date of this Act is
2828 governed by the law applicable to the proceeding immediately before
2929 the effective date of this Act, and that law is continued in effect
3030 for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2021.
