55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the contract terms of certain grants awarded by the
88 Cancer Prevention and Research Institute of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.255(d), Health and Safety Code, is
1111 amended to read as follows:
1212 (d) Before the oversight committee may award [make] for
1313 cancer research any grant from the [of any] proceeds of the bonds
1414 issued under Subchapter E, the recipient of the grant must certify
1515 that the recipient has an amount of funds equal to one-half of the
1616 grant amount and dedicate those funds to the research that is the
1717 subject of the grant request. The institute shall adopt rules
1818 specifying how a grant recipient fulfills obligations under this
1919 subchapter. At a minimum, the rules must:
2020 (1) allow a grant recipient that is an institution of
2121 higher education [a public] or a private or independent institution
2222 of higher education, as those terms are defined by Section 61.003,
2323 Education Code, or a research institute or center affiliated with
2424 the institution, to credit toward the recipient's matching funds
2525 the dollar amount equivalent to the difference between the indirect
2626 cost rate authorized by the federal government for research grants
2727 awarded to the recipient and the indirect cost rate authorized by
2828 Section 102.203(c);
2929 (2) require that a grant recipient certify before the
3030 distribution of any money awarded under a grant for cancer
3131 research:
3232 (A) that encumbered funds equal to one-half of
3333 the amount of the total grant award are available and not yet
3434 expended for research that is the subject of the grant; or
3535 (B) if the grant recipient is an institution of
3636 higher education [a public] or a private or independent institution
3737 of higher education, as those terms are defined by Section 61.003,
3838 Education Code, or a research institute or center affiliated with
3939 the institution, the indirect cost rate authorized by the federal
4040 research grants awarded to the recipient;
4141 (3) specify that:
4242 (A) a grant recipient receiving more than one
4343 grant award may provide matching funds certification at an
4444 institutional level;
4545 (B) the recipient of a multiyear grant award may
4646 certify matching funds on a yearly basis; and
4747 (C) grant funds may not be distributed to the
4848 grant recipient until the annual certification of the matching
4949 funds has been approved;
5050 (4) specify that money used for purposes of
5151 certification may include:
5252 (A) federal funds, including funds provided
5353 under the American Recovery and Reinvestment Act of 2009 (Pub. L.
5454 No. 111-5) and the fair market value of drug development support
5555 provided to the recipient by the National Cancer Institute or other
5656 similar programs;
5757 (B) funds of this state;
5858 (C) funds of other states; and
5959 (D) nongovernmental funds, including private
6060 funds, foundation grants, gifts, and donations;
6161 (5) specify that the following items do not qualify
6262 for purposes of the certification required by this subsection:
6363 (A) in-kind costs;
6464 (B) volunteer services furnished to a grant
6565 recipient;
6666 (C) noncash contributions;
6767 (D) income earned by the grant recipient that is
6868 not available at the time of the award;
6969 (E) preexisting real estate of the grant
7070 recipient, including buildings, facilities, and land;
7171 (F) deferred giving, including a charitable
7272 remainder annuity trust, a charitable remainder unitrust, or a
7373 pooled income fund; or
7474 (G) other items as may be determined by the
7575 oversight committee;
7676 (6) require a grant recipient and the institute to
7777 include the certification in the grant award contract;
7878 (7) specify that a grant recipient's failure to
7979 provide certification shall serve as grounds for terminating the
8080 grant award contract;
8181 (8) require a grant recipient to maintain adequate
8282 documentation supporting the source and use of the funds required
8383 by this subsection and to provide documentation to the institute
8484 upon request; and
8585 (9) require that the institute establish a procedure
8686 to conduct an annual review of the documentation supporting the
8787 source and use of funds reported in the required certification.
8888 SECTION 2. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2021.
