66 AN ACT
77 relating to prohibiting the possession or consumption of alcoholic
88 beverages on the premises of certain sexually oriented businesses;
99 creating a criminal offense; providing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Chapter 105, Alcoholic Beverage
1212 Code, is amended to read as follows:
1313 CHAPTER 105. [HOURS OF] SALE AND CONSUMPTION OF ALCOHOLIC
1414 BEVERAGES; HOURS AND OTHER RESTRICTIONS
1515 SECTION 2. Chapter 105, Alcoholic Beverage Code, is amended
1616 by adding Section 105.091 to read as follows:
1717 Sec. 105.091. CONSUMPTION AT CERTAIN SEXUALLY ORIENTED
1818 BUSINESSES PROHIBITED. (a) In this section:
1919 (1) "Nude" means:
2020 (A) entirely unclothed; or
2121 (B) clothed in a manner that leaves uncovered or
2222 visible through less than fully opaque clothing any portion of the
2323 breasts below the top of the areola of the breasts, if the person is
2424 female, or any portion of the genitals or buttocks.
2525 (2) "Sexually oriented business" means a nightclub,
2626 bar, restaurant, or similar commercial enterprise that provides for
2727 an audience of two or more individuals live nude entertainment or
2828 live nude performances.
2929 (b) A person who operates a sexually oriented business that
3030 does not hold a permit or license under this code may not allow a
3131 person to:
3232 (1) consume alcoholic beverages on the business's
3333 premises; or
3434 (2) bring alcoholic beverages onto or possess
3535 alcoholic beverages on the business's premises for the purpose of
3636 consumption by the person on the premises.
3737 (c) A person described by Subsection (b) or that person's
3838 agent commits an offense if the person or that person's agent allows
3939 a person to:
4040 (1) consume alcoholic beverages on the business's
4141 premises; or
4242 (2) bring alcoholic beverages onto or possess
4343 alcoholic beverages on the business's premises for the purpose of
4444 consumption by the person on the business's premises.
4545 (d) A first offense under this section is a Class A
4646 misdemeanor.
4747 (e) If it is shown on the trial of an offense under this
4848 section that the person has previously been finally convicted of
4949 one offense under this section, on conviction the person shall be
5050 punished for a state jail felony.
5151 (f) If it is shown on the trial of an offense under this
5252 section that the person has previously been finally convicted of
5353 two or more offenses under this section, on conviction the person
5454 shall be punished for a third degree felony.
5555 SECTION 3. This Act takes effect September 1, 2021.
