55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to standing to protest certain alcoholic beverage permit
88 and license applications.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) Section 11.431(a), Alcoholic Beverage
1111 Code, as effective until September 1, 2021, is amended to read as
1212 follows:
1313 (a) A member of the public may protest an application for:
1414 (1) an original mixed beverage permit, private club
1515 registration permit, or wine and beer retailer's permit if a
1616 sexually oriented business is to be operated on the premises to be
1717 covered by the permit;
1818 (2) any renewal of a mixed beverage permit, private
1919 club registration permit, or wine and beer retailer's permit if a
2020 sexually oriented business is to be operated on the premises to be
2121 covered by the permit and a petition is presented to the commission
2222 requesting a hearing which is signed by 50 percent of the residents
2323 who reside within 1,000 [300] feet of any property line of the
2424 affected premises;
2525 (3) a private club registration permit or a permit
2626 authorizing the retail sale of alcoholic beverages for on-premises
2727 consumption if the person resides within 300 feet of any property
2828 line of the premises for which the permit is sought; and
2929 (4) a mixed beverage permit or a wine and beer
3030 retailer's permit in a municipality with a population of 1,500,000
3131 or more if:
3232 (A) any point of the property line of the premise
3333 is less than 300 feet from the nearest point on a property line of a
3434 residence, church, school, hospital, day-care facility, or social
3535 service facility, as measured in a straight line; and
3636 (B) 75 percent or more of the permittee's actual
3737 or anticipated gross revenue is from the sale of alcoholic
3838 beverages.
3939 (b) Section 11.431(a), Alcoholic Beverage Code, as
4040 effective September 1, 2021, is amended to read as follows:
4141 (a) A member of the public may protest an application for:
4242 (1) an original mixed beverage permit, private club
4343 registration permit, or wine and malt beverage retailer's permit if
4444 a sexually oriented business is to be operated on the premises to be
4545 covered by the permit;
4646 (2) any renewal of a mixed beverage permit, private
4747 club registration permit, or wine and malt beverage retailer's
4848 permit if a sexually oriented business is to be operated on the
4949 premises to be covered by the permit and a petition is presented to
5050 the commission requesting a hearing which is signed by 50 percent of
5151 the residents who reside within 1,000 [300] feet of any property
5252 line of the affected premises;
5353 (3) a private club registration permit or a permit
5454 authorizing the retail sale of alcoholic beverages for on-premises
5555 consumption if the person resides within 300 feet of any property
5656 line of the premises for which the permit is sought; and
5757 (4) a mixed beverage permit or a wine and malt beverage
5858 retailer's permit in a municipality with a population of 1,500,000
5959 or more if:
6060 (A) any point of the property line of the premise
6161 is less than 300 feet from the nearest point on a property line of a
6262 residence, church, school, hospital, day-care facility, or social
6363 service facility, as measured in a straight line; and
6464 (B) 75 percent or more of the permittee's actual
6565 or anticipated gross revenue is from the sale of alcoholic
6666 beverages.
6767 SECTION 2. Section 61.313(a), Alcoholic Beverage Code, is
6868 amended to read as follows:
6969 (a) A member of the public may protest an application for:
7070 (1) an original retail dealer's on-premise license if
7171 a sexually oriented business is to be operated on the premises to be
7272 covered by the license;
7373 (2) any renewal of a retail dealer's on-premise
7474 license if a sexually oriented business is to be operated on the
7575 premises to be covered by the license and a petition is presented to
7676 the commission that is signed by 50 percent of the residents who
7777 reside within 1,000 [300] feet of any property line of the affected
7878 premises; or
7979 (3) a license authorizing the retail sale of malt
8080 beverages for on-premises consumption if the person resides within
8181 300 feet of any property line of the premises for which the license
8282 is sought.
8383 SECTION 3. The changes in law made by this Act apply to an
8484 application for an alcoholic beverage permit or license filed on or
8585 after the effective date of this Act or pending on the effective
8686 date of this Act.
8787 SECTION 4. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2021.
