55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the issuance of revenue bonds to fund
88 capital projects at public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.1791 to read as follows:
1212 Sec. 55.1791. SPECIFIC UNIVERSITY SYSTEMS AND
1313 INSTITUTIONS; ADDITIONAL BONDS. (a) In addition to the other
1414 authority granted by this subchapter, each of the following boards
1515 of regents may acquire, purchase, construct, improve, renovate,
1616 enlarge, or equip facilities, including roads and related
1717 infrastructure, for one or more projects chosen by the board for
1818 institutions or entities under the board's management and control:
1919 (1) the board of regents of The Texas A&M University
2020 System;
2121 (2) the board of regents of The University of Texas
2222 System;
2323 (3) the board of regents of the University of Houston
2424 System;
2525 (4) the board of regents of the Texas State University
2626 System;
2727 (5) the board of regents of the University of North
2828 Texas System;
2929 (6) the board of regents of Texas Woman's University;
3030 (7) the board of regents of Midwestern State
3131 University;
3232 (8) the board of regents of Stephen F. Austin State
3333 University;
3434 (9) the board of regents of the Texas Tech University
3535 System; and
3636 (10) the board of regents of Texas Southern
3737 University.
3838 (b) Each board may finance projects under Subsection (a)
3939 through the issuance of bonds in accordance with this subchapter
4040 and, if applicable, in accordance with a systemwide revenue
4141 financing program adopted by the board, in an aggregate principal
4242 amount not to exceed $50 million.
4343 (c) Each board may pledge irrevocably to the payment of
4444 bonds authorized by this section all or any part of the revenue
4545 funds of the university system or institution, as applicable,
4646 including student tuition charges. The amount of a pledge made
4747 under this subsection may not be reduced or abrogated while the
4848 bonds for which the pledge is made, or bonds issued to refund those
4949 bonds, are outstanding.
5050 SECTION 2. This Act does not affect any authority or
5151 restriction regarding the activities that a public institution of
5252 higher education may conduct in connection with a facility financed
5353 by bonds authorized by this Act.
5454 SECTION 3. This Act takes effect September 1, 2021.
