55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of remote technology when conducting probate or
88 guardianship proceedings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 53, Estates Code, is
1111 amended by adding Section 53.108 to read as follows:
1212 Sec. 53.108. USE OF REMOTE TECHNOLOGY IN PROBATE
1313 PROCEEDINGS. (a) In this section, "remote technology" includes
1414 teleconference and videoconference technology.
1515 (b) A probate proceeding conducted through remote
1616 technology is considered to be conducted in open court. Testimony
1717 provided through remote technology in a probate proceeding is
1818 considered to be taken in open court. A decision, order, decree, or
1919 judgment rendered through remote technology in a probate proceeding
2020 is considered to be rendered in open court.
2121 (c) A court that conducts a probate proceeding through
2222 remote technology must:
2323 (1) ensure that the public maintains access to the
2424 proceeding; and
2525 (2) establish and make readily available to the
2626 parties and the public guidelines regarding the conduct of probate
2727 proceedings through remote technology.
2828 SECTION 2. Subchapter C, Chapter 1053, Estates Code, is
2929 amended by adding Section 1053.106 to read as follows:
3030 Sec. 1053.106. USE OF REMOTE TECHNOLOGY IN GUARDIANSHIP
3131 PROCEEDINGS. (a) In this section, "remote technology" includes
3232 teleconference and videoconference technology.
3333 (b) A guardianship proceeding conducted through remote
3434 technology is considered to be conducted in open court. Testimony
3535 provided through remote technology in a guardianship proceeding is
3636 considered to be taken in open court. A decision, order, decree, or
3737 judgment rendered through remote technology in a guardianship
3838 proceeding is considered to be rendered in open court.
3939 (c) A court that conducts a guardianship proceeding through
4040 remote technology must:
4141 (1) ensure that the public maintains access to the
4242 proceeding; and
4343 (2) establish and make readily available to the
4444 parties and the public guidelines regarding the conduct of
4545 guardianship proceedings through remote technology.
4646 SECTION 3. The changes in law made by this Act apply to a
4747 probate or guardianship proceeding that is pending on, or commenced
4848 on or after, the effective date of this Act.
4949 SECTION 4. This Act takes effect September 1, 2021.
