55 A BILL TO BE ENTITLED
66 relating to a notification requirement if a public school,
77 including an open-enrollment charter school, does not have a nurse,
88 school counselor, or librarian assigned to the school during all
99 instructional hours.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 25, Education Code, is
1212 amended by adding Section 25.096 to read as follows:
1313 Sec. 25.096. PARENTAL NOTIFICATION CONCERNING NURSES,
1414 SCHOOL COUNSELORS, AND LIBRARIANS. (a) In this section:
1515 (1) "Librarian" means a person certified as a
1616 librarian under Subchapter B, Chapter 21.
1717 (2) "Nurse" means a person licensed under Chapter 301,
1818 Occupations Code.
1919 (3) "School counselor" means a person certified as a
2020 school counselor under Subchapter B, Chapter 21.
2121 (b) Except as otherwise provided by Subsection (i), a public
2222 school, including an open-enrollment charter school, that does not
2323 have a full-time nurse, school counselor, or librarian or the
2424 equivalent of a full-time nurse, school counselor, or librarian
2525 assigned to be present at the school for more than 30 consecutive
2626 instructional days during the same school year shall provide
2727 written notice of the absence to the parent of or other person
2828 standing in parental relation to each student enrolled in the
2929 school.
3030 (c) A school has the equivalent of a full-time nurse under
3131 Subsection (b) if the school has two or more nurses assigned to the
3232 school and all regular student instructional hours at the campus
3333 during the regular school day are covered by the assignment of at
3434 least one nurse.
3535 (d) A school has the equivalent of a full-time school
3636 counselor under Subsection (b) if the school has two or more school
3737 counselors assigned to the school and all regular student
3838 instructional hours at the campus during the regular school day are
3939 covered by the assignment of at least one school counselor.
4040 (e) A school has the equivalent of a full-time librarian
4141 under Subsection (b) if the school has two or more librarians
4242 assigned to the school and all regular student instructional hours
4343 at the campus during the regular school day are covered by the
4444 assignment of at least one librarian.
4545 (f) The principal of the school shall provide the notice
4646 required by Subsection (b) not later than the 30th instructional
4747 day after the first day the school does not have a full-time nurse,
4848 school counselor, or librarian assigned to be present at the
4949 school.
5050 (g) The school shall:
5151 (1) make a good faith effort to ensure that the notice
5252 required by this section is provided in a bilingual form to any
5353 parent or other person standing in parental relation whose primary
5454 language is not English; and
5555 (2) retain a copy of any notice provided under this
5656 section.
5757 (h) A school may satisfy the notice requirement under
5858 Subsection (f) by posting the notice on the school's Internet
5959 website. Notice posted under this subsection must be accessible
6060 from the home page of the Internet website by use of not more than
6161 three links.
6262 (i) This section does not apply to a school district or
6363 open-enrollment charter school with a student enrollment of less
6464 than 10,000 students.
6565 SECTION 2. This Act applies beginning with the 2021-2022
6666 school year.
6767 SECTION 3. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2021.
