| 7 | 7 | | relating to an optional county fee on vehicle registration in |
|---|
| 8 | 8 | | certain counties to be used for transportation projects. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 502.402(a) and (e), Transportation |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) This section applies only to: |
|---|
| 13 | 13 | | (1) a county that: |
|---|
| 14 | 14 | | (A) borders the United Mexican States; and |
|---|
| 15 | 15 | | (B) has a population of more than 250,000; [and] |
|---|
| 16 | 16 | | (2) a county that has a population of more than 1.5 |
|---|
| 17 | 17 | | million that is coterminous with a regional mobility authority; and |
|---|
| 18 | 18 | | (3) a county: |
|---|
| 19 | 19 | | (A) that has a population of more than 320,000; |
|---|
| 20 | 20 | | (B) that does not border the United Mexican |
|---|
| 21 | 21 | | States; and |
|---|
| 22 | 22 | | (C) in which a port authority is authorized to |
|---|
| 23 | 23 | | issue permits for oversize or overweight vehicles under Chapter |
|---|
| 24 | 24 | | 623. |
|---|
| 25 | 25 | | (e) The additional fee shall be collected for a vehicle when |
|---|
| 26 | 26 | | other fees imposed under this chapter are collected. The fee |
|---|
| 27 | 27 | | revenue collected shall be: |
|---|
| 28 | 28 | | (1) sent to a regional mobility authority located in |
|---|
| 29 | 29 | | the county to fund long-term transportation projects in the county |
|---|
| 30 | 30 | | that are consistent with the purposes specified by Section 7-a, |
|---|
| 31 | 31 | | Article VIII, Texas Constitution; or |
|---|
| 32 | 32 | | (2) if there is no regional mobility authority located |
|---|
| 33 | 33 | | in the county, used by the county only to fund long-term |
|---|
| 34 | 34 | | transportation projects in the county that are consistent with the |
|---|
| 35 | 35 | | purposes specified by Section 7-a, Article VIII, Texas |
|---|
| 36 | 36 | | Constitution. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2021. |
