55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an optional county fee on vehicle registration in
88 certain counties to be used for transportation projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 502.402(a) and (e), Transportation
1111 Code, are amended to read as follows:
1212 (a) This section applies only to:
1313 (1) a county that:
1414 (A) borders the United Mexican States; and
1515 (B) has a population of more than 250,000; [and]
1616 (2) a county that has a population of more than 1.5
1717 million that is coterminous with a regional mobility authority; and
1818 (3) a county:
1919 (A) that has a population of more than 320,000;
2020 (B) that does not border the United Mexican
2121 States; and
2222 (C) in which a port authority is authorized to
2323 issue permits for oversize or overweight vehicles under Chapter
2424 623.
2525 (e) The additional fee shall be collected for a vehicle when
2626 other fees imposed under this chapter are collected. The fee
2727 revenue collected shall be:
2828 (1) sent to a regional mobility authority located in
2929 the county to fund long-term transportation projects in the county
3030 that are consistent with the purposes specified by Section 7-a,
3131 Article VIII, Texas Constitution; or
3232 (2) if there is no regional mobility authority located
3333 in the county, used by the county only to fund long-term
3434 transportation projects in the county that are consistent with the
3535 purposes specified by Section 7-a, Article VIII, Texas
3636 Constitution.
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2021.
