| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 2252.201(1), Government Code, is amended |
|---|
| 10 | 12 | | to read as follows: |
|---|
| 11 | 13 | | (1) "Governmental entity" means this state or a board, |
|---|
| 12 | 14 | | commission, department, office, or other agency in the executive |
|---|
| 13 | 15 | | branch of state government, including an institution of higher |
|---|
| 14 | 16 | | education as defined by Section 61.003, Education Code. The term |
|---|
| 15 | 17 | | does not include a political subdivision. |
|---|
| 16 | 18 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 17 | 19 | | bid documents submitted or contracts entered into on or after the |
|---|
| 18 | 20 | | effective date of this Act. |

| 19 | 21 | | SECTION 3. This Act takes effect September 1, 2021. |
