7 | 7 | | relating to the eligibility of certain retired firefighters and |

8 | 8 | | emergency medical services providers to purchase continued health |

9 | 9 | | benefits coverage. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 175.001, Local Government Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | Sec. 175.001. APPLICABILITY. This chapter applies to a |
---|
14 | 14 | | person who: |
---|
15 | 15 | | (1) retires from: |
---|
16 | 16 | | (A) county employment in a county with a |
---|
17 | 17 | | population of 75,000 or more; |
---|
18 | 18 | | (B) employment by an appraisal district in a |
---|
19 | 19 | | county with a population of 75,000 or more; [or] |
---|
20 | 20 | | (C) municipal employment in a municipality with a |
---|
21 | 21 | | population of 25,000 or more; or |
---|
22 | 22 | | (D) employment as a firefighter or emergency |
---|
23 | 23 | | medical services provider by an emergency services district located |
---|
24 | 24 | | wholly or partly in a county with a population of 200,000 or more; |
---|
25 | 25 | | and |
---|
26 | 26 | | (2) is entitled to receive retirement benefits from a |
---|
27 | 27 | | county, appraisal district, or municipal retirement plan or |
---|
28 | 28 | | emergency services district. |
---|
29 | 29 | | SECTION 2. (a) Chapter 175, Local Government Code, as |
---|
30 | 30 | | amended by this Act, applies according to its terms to all eligible |
---|
31 | 31 | | persons who leave employment with an emergency services district on |
---|
32 | 32 | | or after January 1, 2022. |
---|
33 | 33 | | (b) An emergency services district that is required by |
---|
34 | 34 | | Chapter 175, Local Government Code, as amended by this Act, to |
---|
35 | 35 | | provide continued health benefits coverage but that is not allowed |
---|
36 | 36 | | to provide the coverage under the terms of the district's existing |
---|
37 | 37 | | group health plan shall ensure that the required continued health |
---|
38 | 38 | | benefits coverage is provided for in any new plan that is adopted by |
---|
39 | 39 | | the district on or after January 1, 2022, unless the district is |
---|
40 | 40 | | exempted under Section 175.007, Local Government Code. |
---|
41 | 41 | | SECTION 3. This Act takes effect September 1, 2021. |
