| 8 | 8 | | on Jail Standards. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 511, Government Code, is amended by |
|---|
| 11 | 11 | | adding Section 511.0107 to read as follows: |
|---|
| 12 | 12 | | Sec. 511.0107. UNANNOUNCED ANNUAL INSPECTIONS OF COUNTY |
|---|
| 13 | 13 | | JAILS. (a) The commission shall annually conduct an unannounced |
|---|
| 14 | 14 | | inspection of each county jail. The inspection must evaluate: |
|---|
| 15 | 15 | | (1) the jail's treatment of and policies regarding |
|---|
| 16 | 16 | | pregnant prisoners, including the jail's compliance with: |
|---|
| 17 | 17 | | (A) the minimum requirements established under |
|---|
| 18 | 18 | | Section 511.009(a)(18); and |
|---|
| 19 | 19 | | (B) the rules and procedures established under |
|---|
| 20 | 20 | | Section 511.0104, as added by Chapter 1074 (H.B. 1651), Acts of the |
|---|
| 21 | 21 | | 86th Legislature, Regular Session, 2019; and |
|---|
| 22 | 22 | | (2) the living conditions and general welfare of all |
|---|
| 23 | 23 | | prisoners. |
|---|
| 24 | 24 | | (b) The commission may conduct the inspection required |
|---|
| 25 | 25 | | under this section in conjunction with an inspection conducted |
|---|
| 26 | 26 | | under Section 511.009(a)(9) or (15). |
|---|
| 27 | 27 | | (c) The commission shall: |
|---|
| 28 | 28 | | (1) annually hold a public meeting on the commission's |
|---|
| 29 | 29 | | findings concerning the inspections conducted under this section |
|---|
| 30 | 30 | | during the preceding year; and |
|---|
| 31 | 31 | | (2) include in the annual report submitted under |
|---|
| 32 | 32 | | Section 511.015: |
|---|
| 33 | 33 | | (A) the findings described by Subdivision (1); |
|---|
| 34 | 34 | | and |
|---|
| 35 | 35 | | (B) any recommendations for legislative or other |
|---|
| 36 | 36 | | action. |
|---|
| 37 | 37 | | (d) In developing recommendations under Subsection (c)(2), |
|---|
| 38 | 38 | | the commission shall solicit and consider stakeholder input. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect January 1, 2022. |
