55 AN ACT
66 relating to the use of supported decision-making agreements by
77 persons during court proceedings.
88 SECTION 1. Subtitle D, Title 2, Government Code, is amended
99 by adding Chapter 57A to read as follows:
1010 CHAPTER 57A. SUPPORTED DECISION-MAKING AGREEMENTS
1111 Sec. 57A.001. DEFINITIONS. In this chapter:
1212 (1) "Supported decision-making agreement" is an
1313 agreement between an adult with a disability and a supporter
1414 entered into under Chapter 1357, Estates Code.
1515 (2) "Supporter" means an adult who has entered into a
1616 supported decision-making agreement with an adult with a
1717 disability.
1818 Sec. 57A.002. USE OF A SUPPORTED DECISION-MAKING AGREEMENT.
1919 (a) If the court is notified by a party that the defendant is
2020 qualified to utilize a supported decision-making agreement under
2121 Chapter 1357, Estates Code, and will be present at an arraignment,
2222 hearing, examining trial, or other proceeding, the court shall
2323 allow the defendant to use a supporter pursuant to a supported
2424 decision-making agreement.
2525 (b) Following the filing of an indictment, information, or
2626 complaint against a defendant who is qualified to utilize a
2727 supported decision-making agreement under Chapter 1357, Estates
2828 Code, the court on the motion of the defendant shall allow the
2929 defendant to use a supporter to support the defendant pursuant to
3030 the defendant's supported decision-making agreement. The supporter
3131 may not disclose a communication between the defendant and defense
3232 counsel or a fact that came to the attention of the supporter while
3333 supporting the defendant if defense counsel may not disclose that
3434 communication or fact.
3535 (c) The supporter allowed under the terms of this Article
3636 shall be required to take an oath that the supporter will provide
3737 support to the individual under the terms of the supported
3838 decision-making agreement in effect and that the supporter will not
3939 undermine the decision-making authority of the defendant.
4040 (d) Supplying a supporter utilized under this chapter is the
4141 responsibility of the defendant and a supporter is not entitled to a
4242 fee from the court for supporting the defendant.
4343 SECTION 2. Subtitle B, Title 2, Civil Practice and Remedies
4444 Code is amended by adding Chapter 21A to read as follows:
4545 CHAPTER 21A. SSUPPORTED DECISION-MAKING AGREEMENTS
4646 Sec. 21A.002. DEFINITIONS. In this chapter:
4747 (1) "Supported decision-making agreement" is an
4848 agreement between an adult with a disability and a supporter
4949 entered into under Chapter 1357, Estates Code.
5050 (2) "Supporter" means an adult who has entered into a
5151 supported decision-making agreement with an adult with a
5252 disability.
5353 Sec. 21A.002. USE OF A SUPPORTED DECISION-MAKING AGREEMENT.
5454 (a) In a civil case or in a deposition, a person who is a party or
5555 witness is qualified to utilize a supported decision-making
5656 agreement under Chapter 1357, Estates Code, the party or witness is
5757 entitled to use the services of a supporter under the terms of a
5858 supported decision-making agreement.
5959 (b) The supporter shall take an oath that the supporter will
6060 provide support to the individual under the terms of the supported
6161 decision-making agreement in effect and that the supporter will not
6262 undermine the decision-making authority of the party or witness.
6363 (c) Supplying a supporter utilized under this chapter is the
6464 responsibility of the party requesting to use the supporter and a
6565 supporter is not entitled to a fee from the court for supporting the
6666 party or witness.
6767 (d) If an individual utilizes a supporter pursuant to a
6868 supported decision-making agreement and the supporter communicates
6969 to the individual under circumstances in which the communication
7070 would be privileged and the party could not be required to testify
7171 about the communication, the privilege applies to the supporter as
7272 well.
7373 SECTION 3. This Act takes effect September 1, 2021.
