57 relating to the management and operation by The University of Texas
68 System of a multi-institution center in the city of Laredo.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. The heading to Subchapter M, Chapter 74,
911 Education Code, is amended to read as follows:
1012 SUBCHAPTER M. UNIVERSITY OF TEXAS SYSTEM MULTI-INSTITUTION [HEALTH
1113 SCIENCE] CENTER IN LAREDO [AT SAN ANTONIO CAMPUS EXTENSION]
1214 SECTION 2. Section 74.701, Education Code, is amended to
1315 read as follows:
1416 Sec. 74.701. AUTHORITY TO ESTABLISH CENTER [CAMPUS
1517 EXTENSION]. The board of regents of The University of Texas System
1618 shall establish and operate a multi-institution center [campus
1719 extension of The University of Texas Health Science Center at San
1820 Antonio] in the city of Laredo if:
1921 (1) a public or private entity offers the board of
2022 regents sufficient land in that city to construct a center [campus
2123 extension]; and
2224 (2) public or private entities agree to provide funds
2325 necessary to construct an administrative building for the center
2426 [campus extension].
2527 SECTION 3. Section 74.702, Education Code, is amended to
2628 read as follows:
2729 Sec. 74.702. MANAGEMENT AND OPERATION OF CENTER [CAMPUS
2830 EXTENSION]. (a) The board of regents may exercise any power
2931 granted to the board under Subchapter D in establishing and
3032 operating the center [campus extension].
3133 (b) The board of regents may [shall] assign responsibility
3234 for management of the center to a component institution of the
3335 system [campus extension to The University of Texas Health Science
3436 Center at San Antonio].
3537 (c) The operating costs of the center [campus extension]
3638 shall be paid from [the operating funds of The University of Texas
3739 Health Science Center at San Antonio for that purpose and from]
3840 available funds from any public or private entity.
3941 (d) The primary purpose of the center [campus extension] is
4042 to host [support] educational activities, conduct and facilitate
4143 research, and engage in community outreach. Component institutions
4244 of the system may use the center in accordance with its primary
4345 purpose [The campus extension may be used] to provide undergraduate
4446 and graduate medical and dental education, including residency
4547 training programs, and other levels of health education work in
4648 collaboration with any public institution of higher education
4749 considered appropriate by the board of regents [Texas A&M
4850 International University or any component institution of The Texas
4951 A&M University System or The University of Texas System].
5052 SECTION 4. Section 74.703, Education Code, is amended to
5153 read as follows:
5254 Sec. 74.703. GIFTS AND GRANTS. The board of regents may
5355 accept and administer gifts and grants from any public or private
5456 person or entity for the use and benefit of the center [campus
5557 extension], including accepting and administering gifts and grants
5658 of land and physical facilities.
5759 SECTION 5. Section 74.704(a), Education Code, is amended to
5860 read as follows:
5961 (a) The physical facilities of the center [campus
6062 extension] used in teaching and research programs, including
6163 libraries, auditoriums, research facilities, and health education
6264 buildings, may be provided by a public or private entity. The board
6365 of regents may [is authorized to] lease the facilities that are to
6466 be used as the physical facilities of the center [campus
6567 extension].
6668 SECTION 6. Section 63.102(c), Education Code, is amended to
6769 read as follows:
6870 (c) The amount available for distribution from each fund may
6971 be appropriated only for research and other programs that are
7072 conducted by the institution or components for which the fund is
7173 established and that benefit the public health. The comptroller or
7274 the governing board shall report to the legislature the amount of
7375 funds that are eligible for appropriation. An amount appropriated
7476 from the fund established for The University of Texas Health
7577 Science Center at San Antonio may be used to establish, maintain,
7678 and operate a children's cancer center. An amount appropriated
7779 from the funds established for the component institutions of The
7880 University of Texas System may be used to maintain, operate, and
7981 conduct health education programs and other related work at the
8082 system's multi-institution center [and the campus extension] in the
8183 city of Laredo. An amount appropriated from the funds established
8284 for the components of the Texas Tech University Health Sciences
8385 Center located in El Paso and for The University of Texas at El Paso
8486 may be used for the establishment and operation of an institute of
8587 public health in El Paso. An amount appropriated from the fund
8688 established for the components of the Texas Tech University Health
8789 Sciences Center at locations other than El Paso may be used for
8890 research and other programs that benefit the public health in areas
8991 outside El Paso. An amount appropriated from the fund established
9092 for The Texas A&M University Health Science Center may be used for
9193 the establishment and operation of the Coastal Bend Health
9294 Education Center in Corpus Christi.
9395 SECTION 7. Section 74.705, Education Code, is repealed.
9496 SECTION 8. This Act takes effect September 1, 2021.
