55 AN ACT
66 relating to the procedures of the State Commission on Judicial
77 Conduct.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.0211(b), Government Code, is amended
1010 to read as follows:
1111 (b) The commission, [at least quarterly] until final
1212 disposition of the complaint, shall notify the person filing the
1313 complaint of any change in the status of the complaint
1414 investigation unless the notice would jeopardize an undercover
1515 investigation.
1616 SECTION 2. Subchapter B, Chapter 33, Government Code, is
1717 amended by adding Sections 33.02114, 33.02115, and 33.02116 to read
1818 as follows:
1919 Sec. 33.02114. COMPLAINT INFORMATION ON COMMISSION
2020 WEBSITE. The commission shall maintain on the commission's
2121 Internet website a statement that a complainant is not required to
2222 maintain confidentiality of the complaint filed by the complainant.
2323 Sec. 33.02115. SANCTION GUIDELINES. The commission shall
2424 establish guidelines for the imposition of a sanction to ensure
2525 each sanction imposed is proportional to the judicial misconduct.
2626 Sec. 33.02116. COMPLAINT SCHEDULE. The commission shall
2727 establish a schedule outlining times for commission action on a
2828 complaint. The schedule must allow the executive director to
2929 approve an extension of time for complaint disposition due to
3030 extenuating circumstances, including a need for further
3131 investigation.
3232 SECTION 3. This Act takes effect September 1, 2021.
