44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the ineligibility of certain local governments for
77 certain criminal justice grants as a result of budget reductions
88 affecting local law enforcement agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 772, Government Code, is
1111 amended by adding Section 772.0065 to read as follows:
1212 Sec. 772.0065. INELIGIBILITY FOR GRANT FOLLOWING CERTAIN
1313 BUDGET REDUCTIONS. (a) In this section:
1414 (1) "Criminal justice division" means the criminal
1515 justice division established under Section 772.006.
1616 (2) "Local government" means a municipality or county.
1717 (b) A local government is ineligible to receive a grant
1818 awarded by the criminal justice division if the division determines
1919 that:
2020 (1) the local government has adopted a budget for a
2121 fiscal year for the sheriff's department or municipal police
2222 department, as applicable, that in comparison to the preceding
2323 fiscal year reduces the budget of the department by 5 percent or
2424 more and the reduction is not due to a similar decrease in the
2525 amount of tax revenue collected by the local government; and
2626 (2) the reduction will have a significant, adverse
2727 effect on public safety within the applicable county or
2828 municipality.
2929 (c) A local government that is receiving money under a grant
3030 awarded by the criminal justice division shall notify the division
3131 of any reduction described by Subsection (b)(1) not later than the
3232 15th day after the date the reduction takes effect. At the request
3333 of the criminal justice division, the local government shall
3434 provide a description of the reduction and any anticipated effects
3535 on public safety.
3636 (d) The criminal justice division shall require a local
3737 government applying for a grant to:
3838 (1) disclose whether the most recent budget of the
3939 local government constitutes a reduction as described by Subsection
4040 (b)(1); and
4141 (2) provide a description of the reduction and any
4242 anticipated effects on public safety.
4343 SECTION 2. The change in law made by this Act applies only
4444 with respect to the adoption of a budget by a municipality or county
4545 for a fiscal year that begins on or after the effective date of this
4646 Act.
4747 SECTION 3. This Act takes effect September 1, 2021.
