| 6 | 6 | | relating to the ineligibility of certain local governments for |

| 7 | 7 | | certain criminal justice grants as a result of budget reductions |
|---|
| 8 | 8 | | affecting local law enforcement agencies. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 772, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 772.0065 to read as follows: |
|---|
| 12 | 12 | | Sec. 772.0065. INELIGIBILITY FOR GRANT FOLLOWING CERTAIN |
|---|
| 13 | 13 | | BUDGET REDUCTIONS. (a) In this section: |
|---|
| 14 | 14 | | (1) "Criminal justice division" means the criminal |
|---|
| 15 | 15 | | justice division established under Section 772.006. |
|---|
| 16 | 16 | | (2) "Local government" means a municipality or county. |
|---|
| 17 | 17 | | (b) A local government is ineligible to receive a grant |
|---|
| 18 | 18 | | awarded by the criminal justice division if the division determines |
|---|
| 19 | 19 | | that: |
|---|
| 20 | 20 | | (1) the local government has adopted a budget for a |
|---|
| 21 | 21 | | fiscal year for the sheriff's department or municipal police |
|---|
| 22 | 22 | | department, as applicable, that in comparison to the preceding |
|---|
| 23 | 23 | | fiscal year reduces the budget of the department by 5 percent or |
|---|
| 24 | 24 | | more and the reduction is not due to a similar decrease in the |
|---|
| 25 | 25 | | amount of tax revenue collected by the local government; and |
|---|
| 26 | 26 | | (2) the reduction will have a significant, adverse |
|---|
| 27 | 27 | | effect on public safety within the applicable county or |
|---|
| 28 | 28 | | municipality. |
|---|
| 29 | 29 | | (c) A local government that is receiving money under a grant |
|---|
| 30 | 30 | | awarded by the criminal justice division shall notify the division |
|---|
| 31 | 31 | | of any reduction described by Subsection (b)(1) not later than the |
|---|
| 32 | 32 | | 15th day after the date the reduction takes effect. At the request |
|---|
| 33 | 33 | | of the criminal justice division, the local government shall |
|---|
| 34 | 34 | | provide a description of the reduction and any anticipated effects |
|---|
| 35 | 35 | | on public safety. |
|---|
| 36 | 36 | | (d) The criminal justice division shall require a local |
|---|
| 37 | 37 | | government applying for a grant to: |
|---|
| 38 | 38 | | (1) disclose whether the most recent budget of the |
|---|
| 39 | 39 | | local government constitutes a reduction as described by Subsection |
|---|
| 40 | 40 | | (b)(1); and |
|---|
| 41 | 41 | | (2) provide a description of the reduction and any |
|---|
| 42 | 42 | | anticipated effects on public safety. |
|---|
| 43 | 43 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 44 | 44 | | with respect to the adoption of a budget by a municipality or county |
|---|
| 45 | 45 | | for a fiscal year that begins on or after the effective date of this |
|---|
| 46 | 46 | | Act. |

| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2021. |
