| 7 | 7 | | relating to ticket sales for charitable raffles conducted by the |

| 8 | 8 | | charitable foundations of certain professional sports teams. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2004.004, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subsections (a-1) and (a-2) to read as follows: |
|---|
| 12 | 12 | | (a-1) Raffle tickets for a charitable raffle conducted |
|---|
| 13 | 13 | | under Subsection (a) may be sold: |
|---|
| 14 | 14 | | (1) at the home venue of the professional sports team |
|---|
| 15 | 15 | | associated with the foundation conducting the raffle; or |
|---|
| 16 | 16 | | (2) through digital interactive media, including an |
|---|
| 17 | 17 | | Internet website of or mobile application provided by the |
|---|
| 18 | 18 | | professional sports team associated with the foundation conducting |
|---|
| 19 | 19 | | the raffle. |
|---|
| 20 | 20 | | (a-2) Raffle tickets sold under Subsection (a-1)(2) may |
|---|
| 21 | 21 | | only be sold to individuals physically located in this state at the |
|---|
| 22 | 22 | | time of the sale. |

| 23 | 23 | | SECTION 2. Sections 2004.002(1-a) and 2004.009(a), |
|---|
| 24 | 24 | | Occupations Code, are repealed. |
|---|
| 25 | 25 | | SECTION 3. The repeal by this Act of Section 2004.009(a), |
|---|
| 26 | 26 | | Occupations Code, does not apply to an offense committed under that |
|---|
| 27 | 27 | | section before the effective date of the repeal. An offense |
|---|
| 28 | 28 | | committed before the effective date of the repeal is governed by the |
|---|
| 29 | 29 | | law as it existed on the date the offense was committed, and the |
|---|
| 30 | 30 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 31 | 31 | | this section, an offense was committed before the effective date of |
|---|
| 32 | 32 | | the repeal if any element of the offense occurred before that date. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2021. |
