117 relating to a border operations training program for peace officers
128 employed by local law enforcement agencies.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1511 amended by adding Section 411.02096 to read as follows:
1612 Sec. 411.02096. BORDER OPERATIONS TRAINING PROGRAM. (a)
1713 The department, in coordination with local law enforcement
1814 agencies, shall establish and administer a border operations
1915 training program for peace officers employed by local law
2016 enforcement agencies that will prepare the officers to:
2117 (1) collaborate and cooperate with and assist any law
2218 enforcement agency in the interdiction, investigation, and
2319 prosecution of criminal activity in the Texas-Mexico border region;
2420 and
2521 (2) collaborate and cooperate with and assist district
2622 attorneys, county attorneys, the border prosecution unit, and other
2723 prosecutors in the investigation and prosecution of allegations of
2824 criminal activity in the Texas-Mexico border region.
2925 (b) The training program under Subsection (a) must include:
3026 (1) information on:
3127 (A) criminal activity occurring along the
3228 Texas-Mexico border, including drug trafficking and trafficking of
3329 persons and other activity carried out by cartels, transnational
3430 gangs, and other groups engaged in organized criminal activity; and
3531 (B) methods for identifying northbound,
3632 southbound, and intrastate criminal activity associated with drug
3733 trafficking, trafficking of persons, and other organized criminal
3834 activity;
3935 (2) best practices for investigating and prosecuting
4036 the criminal activity described by Subdivision (1) and securing the
4137 Texas-Mexico border; and
4238 (3) an overview of the department's operations at the
4339 Texas-Mexico border, including any collaboration with the United
4440 States Customs and Border Protection.
4541 (c) The department shall identify opportunities for a peace
4642 officer described by Subsection (a) to assist in the department's
4743 duties related to border operations. The department may authorize
4844 the officer to assist in carrying out those duties.
4945 (d) A peace officer authorized by the department to assist
5046 in carrying out duties related to the department's border
5147 operations as described by Subsection (c) is not entitled to
5248 compensation from the department for the assistance provided.
5349 (e) The department may partner with federal agencies in
5450 administering the training program under Subsection (a) and
5551 facilitating any assistance provided by a peace officer under
5652 Subsection (c).
5753 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
5854 amended by adding Section 1701.359 to read as follows:
5955 Sec. 1701.359. BORDER OPERATIONS TRAINING PROGRAM. The
6056 commission may:
6157 (1) recognize, or with the consent of the Department
6258 of Public Safety administer or assist in administering, the border
6359 operations training program established under Section 411.02096,
6460 Government Code, as a continuing education program for officers;
6561 and
6662 (2) credit an officer who successfully completes the
6763 program described by Subdivision (1) with the appropriate number of
6864 continuing education hours.
6965 SECTION 3. This Act takes effect September 1, 2021.
