55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to criminal asset forfeiture proceedings and the seizure
88 and forfeiture of certain property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 59.02, Code of Criminal Procedure, is
1111 amended by amending Subsection (a) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) Except as otherwise provided by Subsection (a-1),
1414 property [Property] that is contraband is subject to seizure and
1515 forfeiture under this chapter.
1616 (a-1) Property that is contraband is not subject to seizure
1717 and forfeiture under this chapter if:
1818 (1) the property is not otherwise unlawful to possess;
1919 and
2020 (2) the admissibility of the property as evidence
2121 would be prohibited under Article 38.23 in the prosecution of the
2222 underlying offense.
2323 SECTION 2. Article 59.021(d), Code of Criminal Procedure,
2424 is amended to read as follows:
2525 (d) After seizure of the substitute property, the
2626 disposition shall proceed as other cases in this chapter except
2727 that the attorney representing the state must prove by clear and
2828 convincing [a preponderance of the] evidence:
2929 (1) that the contraband described by Subsection (b)
3030 was subject to seizure and forfeiture under this chapter;
3131 (2) the highest fair market value of that contraband
3232 during the period in which the owner of the substitute property
3333 owned, or had an interest in, the contraband;
3434 (3) the fair market value of the substitute property
3535 at the time it was seized; and
3636 (4) that the owner of the substitute property owned or
3737 had an interest in contraband with an aggregate value of $200,000 or
3838 more in connection with the commission of an underlying offense
3939 giving rise to the forfeiture.
4040 SECTION 3. Article 59.05, Code of Criminal Procedure, is
4141 amended by amending Subsection (b) and adding Subsection (b-1) to
4242 read as follows:
4343 (b) All cases under this chapter shall proceed to trial in
4444 the same manner as in other civil cases. The state has the burden of
4545 proving by clear and convincing [a preponderance of the] evidence
4646 that property is subject to forfeiture.
4747 (b-1) In a forfeiture proceeding under this chapter, the
4848 attorney representing the state may only present evidence the
4949 admissibility of which would not be prohibited under Article 38.23
5050 in the prosecution of the underlying offense giving rise to the
5151 forfeiture.
5252 SECTION 4. Section 12.1106(d), Parks and Wildlife Code, is
5353 amended to read as follows:
5454 (d) The court shall order the seized property:
5555 (1) forfeited to the department if the court
5656 determines by clear and convincing [a preponderance of the]
5757 evidence that:
5858 (A) the seized property is contraband and a
5959 person pleaded guilty or nolo contendere to, was convicted of, or
6060 was placed on deferred adjudication for:
6161 (i) an offense under Section 66.006,
6262 Section 66.2011, or Subchapter G, Chapter 43, of this code; or
6363 (ii) a second or subsequent offense under
6464 Section 61.022, 62.003, 62.004, or 62.005 of this code; or
6565 (B) the seized property is contraband and no
6666 person was arrested for an offense immediately after the warden or
6767 officer seized the property; or
6868 (2) released to the owner if:
6969 (A) the person charged with an offense under
7070 Section 66.006, Section 66.2011, or Subchapter G, Chapter 43, of
7171 this code or a second or subsequent offense under Section 61.022,
7272 62.003, 62.004, or 62.005 of this code is acquitted or the charge is
7373 dismissed; or
7474 (B) the court determines that the seized property
7575 is not contraband.
7676 SECTION 5. Articles 59.02, 59.021, and 59.05, Code of
7777 Criminal Procedure, and Section 12.1106, Parks and Wildlife Code,
7878 as amended by this Act, apply only to a forfeiture proceeding that
7979 begins on or after the effective date of this Act. A forfeiture
8080 proceeding that begins before the effective date of this Act is
8181 governed by the law in effect on the date the proceeding begins, and
8282 the former law is continued in effect for that purpose.
8383 SECTION 6. This Act takes effect September 1, 2021.
