66 AN ACT
77 relating to improvements to the Texas Medicaid Provider Procedures
88 Manual designed to prevent fraud, waste, or abuse in the provision
99 of Medicaid dental services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITIONS. In this Act:
1212 (1) "Commission" means the Health and Human Services
1313 Commission.
1414 (2) "Executive commissioner" means the executive
1515 commissioner of the commission.
1616 (3) "Medicaid" means the medical assistance program
1717 established under Chapter 32, Human Resources Code.
1818 (4) "Work group" means the work group established
1919 under Section 2 of this Act.
2020 SECTION 2. WORK GROUP ON IMPROVING TEXAS MEDICAID PROVIDER
2121 PROCEDURES MANUAL PROVISIONS RELATING TO DENTAL SERVICES. (a) The
2222 executive commissioner shall establish a work group for the purpose
2323 of providing recommendations to improve the Texas Medicaid Provider
2424 Procedures Manual in a manner that prevents the incidence of fraud,
2525 waste, or abuse in the provision of Medicaid dental services.
2626 (b) The executive commissioner shall appoint the members of
2727 the work group, which must include:
2828 (1) a representative of the commission;
2929 (2) the dental director appointed under Section
3030 531.02114, Government Code;
3131 (3) a representative of the commission's office of
3232 inspector general;
3333 (4) at least one stakeholder to represent each of the
3434 following interests:
3535 (A) managed care organizations that contract
3636 with the commission to provide Medicaid dental services;
3737 (B) providers of Medicaid dental services; and
3838 (C) dental academia; and
3939 (5) additional stakeholders or other persons the
4040 executive commissioner determines appropriate.
4141 (c) The commission shall provide administrative support to
4242 the work group.
4343 (d) The executive commissioner shall appoint a member of the
4444 work group to serve as the presiding officer.
4545 (e) The work group shall meet at the call of the presiding
4646 officer.
4747 (f) The work group shall:
4848 (1) review all provisions in the Texas Medicaid
4949 Provider Procedures Manual related to the provision of dental
5050 services;
5151 (2) determine which provisions can be eliminated or
5252 changed to prevent fraud, waste, or abuse in the provision of dental
5353 services, including changes related to the use of dental procedure
5454 codes by providers; and
5555 (3) make recommendations to the executive
5656 commissioner for improving the Texas Medicaid Provider Procedures
5757 Manual to prevent fraud, waste, or abuse in the provision of dental
5858 services under Medicaid.
5959 SECTION 3. REPORT. Not later than December 31, 2022, the
6060 work group shall submit a report on the work group's
6161 recommendations to the executive commissioner.
6262 SECTION 4. ACTION ON REPORT. On receiving the work group's
6363 recommendations, the executive commissioner shall:
6464 (1) consider immediately adopting the recommendations
6565 of the work group that do not require legislative action; and
6666 (2) if implementation of a recommendation requires
6767 legislative action, submit to the legislature a copy of the report
6868 described by Section 3 of this Act together with the executive
6969 commissioner's recommendations for any legislative action.
7070 SECTION 5. ABOLISHMENT OF WORK GROUP; EXPIRATION. On
7171 January 1, 2023:
7272 (1) the work group is abolished; and
7373 (2) this Act expires.
7474 SECTION 6. FEDERAL AUTHORIZATION. If before implementing
7575 any provision of this Act a state agency determines that a waiver or
7676 authorization from a federal agency is necessary for implementation
7777 of that provision, the agency affected by the provision shall
7878 request the waiver or authorization and may delay implementing that
7979 provision until the waiver or authorization is granted.
8080 SECTION 7. EFFECTIVE DATE. This Act takes effect September
8181 1, 2021.
