55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of certain physicians and nurses to
88 practice in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 155, Occupations Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. RECOGNITION OF OUT-OF-STATE LICENSE
1313 Sec. 155.201. AUTHORITY TO PRACTICE. (a) Notwithstanding
1414 any other law, a person may practice medicine in this state without
1515 obtaining a license under this subtitle if the person is licensed in
1616 good standing as a physician in another jurisdiction that has
1717 licensing requirements that are substantially equivalent to the
1818 requirements for a license under this subtitle.
1919 (b) Before engaging in the practice of medicine in this
2020 state, the person must:
2121 (1) notify the board of the person's intent to practice
2222 in this state; and
2323 (2) receive from the board confirmation that:
2424 (A) the board has verified the person's license
2525 in the other jurisdiction; and
2626 (B) the person is authorized to engage in the
2727 practice of medicine in accordance with this section.
2828 (c) The person shall comply with all other laws and rules
2929 applicable to the practice of medicine in this state.
3030 (d) The board shall adopt rules to implement this section.
3131 The rules must establish a process for the board to:
3232 (1) identify the jurisdictions that have licensing
3333 requirements that are substantially equivalent to the requirements
3434 for a license under this subtitle; and
3535 (2) verify that a person is licensed in good standing
3636 in a jurisdiction described by Subdivision (1).
3737 (e) The board may not impose a fee on a person seeking to
3838 engage in the practice of medicine under this section.
3939 SECTION 2. Subchapter F, Chapter 301, Occupations Code, is
4040 amended by adding Section 301.2515 to read as follows:
4141 Sec. 301.2515. RECOGNITION OF OUT-OF-STATE LICENSE. (a)
4242 Notwithstanding any other law, a person may practice nursing in
4343 this state without obtaining a license under this chapter if the
4444 person is licensed in good standing as a nurse in another
4545 jurisdiction that has licensing requirements that are
4646 substantially equivalent to the requirements for a license under
4747 this chapter.
4848 (b) Before engaging in the practice of nursing in this
4949 state, the person must:
5050 (1) notify the board of the person's intent to practice
5151 in this state; and
5252 (2) receive from the board confirmation that:
5353 (A) the board has verified the person's license
5454 in the other jurisdiction; and
5555 (B) the person is authorized to engage in the
5656 practice of nursing in accordance with this section.
5757 (c) The person shall comply with all other laws and rules
5858 applicable to the practice of nursing in this state.
5959 (d) The board shall adopt rules to implement this section.
6060 The rules must establish a process for the board to:
6161 (1) identify the jurisdictions that have licensing
6262 requirements that are substantially equivalent to the requirements
6363 for a license under this chapter; and
6464 (2) verify that a person is licensed in good standing
6565 in a jurisdiction described by Subdivision (1).
6666 (e) The board may not impose a fee on a person seeking to
6767 engage in the practice of nursing under this section.
6868 SECTION 3. (a) Not later than December 1, 2021, the Texas
6969 Medical Board shall adopt the rules required by Section 155.201,
7070 Occupations Code, as added by this Act.
7171 (b) Not later than December 1, 2021, the Texas Board of
7272 Nursing shall adopt the rules required by Section 301.2515,
7373 Occupations Code, as added by this Act.
7474 SECTION 4. This Act takes effect September 1, 2021.
