79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. (a) Section 38.064, Education Code, is

4144 (c) Chapter 131, Human Resources Code, is repealed.
4245 SECTION 2. Section 43.003(a)(2), Health and Safety Code, is
4346 amended to read as follows:
4447 (2) "Oral health services" means[:
4548 [(A) preventive or treatment services affecting
4649 the structures of the mouth, including the hard and soft tissues
4750 such as teeth, jaws, gums, vestibule, tongue, cheeks, lips, floor
4851 and roof of the mouth, and adjacent masticatory structures; and
4952 [(B)] oral health education and promotion
5053 activities.
5154 SECTION 3. Section 43.004(d), Health and Safety Code, is
5255 amended to read as follows:
5356 (d) The department may establish an oral health services
5457 program that may consist of all or any combination of the following:
5558 (1) [treatment services for eligible individuals,
5659 including:
5760 [(A) emergency care for relief of pain and
5861 infection, including extractions and basic restorative services to
5962 prevent premature loss of teeth;
6063 [(B) periodontal therapy for the prevention and
6164 treatment of periodontal disease;
6265 [(C) endodontics to maintain aesthetics and
6366 occlusion;
6467 [(D) orthodontic care only in cases of severely
6568 handicapping malocclusion; and
6669 [(E) oral surgery and prosthetics in cases in
6770 which health is impaired;
6871 [(2)] a program of oral disease prevention, including:
6972 (A) the fluoridation of community water
7073 supplies;
7174 (B) fluoride mouth rinse programs in schools; and
7275 (C) the promotion and implementation of sealants
7376 programs; [and
7477 [(D) the development of appropriate means for
7578 prevention of oral disease, including the continued use of
7679 recognized methods of primary, secondary, and tertiary
7780 prevention;]
7881 (2) [(3)] oral health education and promotion,
7982 including:
8083 (A) public health education to promote the
8184 prevention of oral disease through self-help methods, including the
8285 initiation and expansion of preschool, school age, and adult
8386 education programs;
8487 (B) organized continuing health education
8588 training programs for health care providers; and
8689 (C) preventive health education information for
8790 the public; and
8891 (3) [(4)] facilitation of access to oral health
8992 services, including:
9093 (A) the improvement of the existing oral health
9194 services delivery system for the provision of services to
9295 low-income residents;
9396 (B) outreach activities to inform the public of
9497 the type and availability of oral health services to increase the
9598 accessibility of oral health care for low-income residents; and
9699 (C) assistance and cooperation in promoting
97100 better distribution of dentists and other oral health professionals
98101 throughout the state.
99102 SECTION 4. Section 101.008, Health and Safety Code, is
100103 amended to read as follows:
101104 Sec. 101.008. DUTIES OF DEPARTMENT. The department shall:
102105 (1) provide administrative assistance, services, and
103106 materials to the council;
104107 (2) accept, deposit, and disburse funds made available
105108 to the council at the direction of the executive commissioner;
106109 (3) accept gifts and grants on behalf of the council
107110 from any public or private entity; and
108111 (4) [maintain a population data base of persons with
109112 Alzheimer's disease and related disorders in this state; and
110113 [(5)] apply for and receive on behalf of the council
111114 any appropriations, gifts, or other funds from the state or federal
112115 government or any other public or private entity, subject to
113116 limitations and conditions prescribed by legislative
114117 appropriation.
115118 SECTION 5. Section 146.005, Health and Safety Code, is
116119 amended to read as follows:
117120 Sec. 146.005. FEES. The executive commissioner by rule
118121 shall set license [and registration fees] and license [and
119122 registration] renewal fees in amounts necessary [for the
120123 department] to administer this chapter.
121124 SECTION 6. Section 146.021(c), Health and Safety Code, is
122125 amended to read as follows:
123126 (c) If the license [or registration] holder cannot be
124127 located for a notice required under this section, the department
125128 shall provide notice by posting a copy of the order on the front
126129 door of the premises of the license holder [or the premises where
127130 the registration holder is employed].
128131 SECTION 7. Section 161.0074(c), Health and Safety Code, is
129132 amended to read as follows:
130133 (c) The report must:
131134 (1) include the current immunization rates by
132135 geographic region of the state, where available;
133136 (2) focus on the geographic regions of the state with
134137 immunization rates below the state average for preschool children;
135138 (3) describe the approaches identified to increase
136139 immunization rates in underserved areas and the estimated cost for
137140 each;
138141 (4) identify changes to department procedures needed
139142 to increase immunization rates;
140143 (5) identify the services provided under and
141144 provisions of contracts entered into by the department to increase
142145 immunization rates in underserved areas;
143146 (6) identify performance measures used in contracts
144147 described by Subdivision (5);
145148 (7) include the number and type of exemptions used in
146149 the past year;
147150 (8) include the number of complaints received by the
148151 department related to the department's failure to comply with
149152 requests for exclusion of individuals from the registry;
150153 (9) identify all reported incidents of discrimination
151154 for requesting exclusion from the registry or for using an
152155 exemption for a required immunization; and
153156 (10) [include department recommendations about the
154157 best way to use, and communicate with, local registries in the
155158 state; and
156159 [(11)] include ways to increase provider
157160 participation in the registry.
158161 SECTION 8. Section 161.352(a), Health and Safety Code, is
159162 amended to read as follows:
160163 (a) Each manufacturer shall file with the department an
161164 annual report for each cigarette or tobacco product distributed in
162165 this state, stating[:
163166 [(1)] the identity of each ingredient in the cigarette
164167 or tobacco product, listed in descending order according to weight,
165168 measure, or numerical count, other than:
166169 (1) [(A)] tobacco;
167170 (2) [(B)] water; or
168171 (3) [(C)] a reconstituted tobacco sheet made wholly
169172 from tobacco[; and
170173 [(2) a nicotine yield rating for the cigarette or
171174 tobacco product established under Section 161.353].
172175 SECTION 9. Sections 431.4031(a) and (b), Health and Safety
173176 Code, are amended to read as follows:
174177 (a) A wholesale distributor that distributes prescription
175178 drugs that are medical gases or a wholesale distributor that is a
176179 manufacturer or a third-party logistics provider on behalf of a
177180 manufacturer is exempt from Sections 431.404(a)(5) and (6), (b),
178181 and (c), 431.4045(2), 431.405, and 431.407[, and 431.408].
179182 (b) A state agency or a political subdivision of this state
180183 that distributes prescription drugs using federal or state funding
181184 to nonprofit health care facilities or local mental health or
182185 mental retardation authorities for distribution to a pharmacy,
183186 practitioner, or patient is exempt from Sections 431.405(b),
184187 431.407, [431.408,] 431.412, and 431.413.
185188 SECTION 10. On the effective date of this Act:
186189 (1) the following are abolished:
187190 (A) the children's outreach heart program;
188191 (B) the oral health improvement services
189192 program;
190193 (C) the arthritis control and prevention
191194 program;
192195 (D) the health care information technology
193196 advisory committee;
194197 (E) the diabetes intervention pilot program;
195198 (F) the prescription drug donation pilot
196199 program; and
197200 (G) the Health and Human Services Office of
198201 Community Transportation Services;
199202 (2) any remaining obligations, rights, contracts,
200203 records, real and personal property, funds, appropriations, and
201204 money of the children's outreach heart program, the arthritis
202205 control and prevention program, the oral health improvement
203206 services program, the diabetes intervention pilot program, and the
204207 prescription drug donation pilot program are transferred to the
205208 Department of State Health Services;
206209 (3) any remaining obligations, rights, contracts,
207210 records, real and personal property, funds, appropriations, and
208211 money of the health care information technology advisory committee
209212 are transferred to the statewide health coordinating council under
210213 Subchapter B, Chapter 104, Health and Safety Code; and
211214 (4) any remaining obligations, rights, contracts,
212215 records, real and personal property, funds, appropriations, and
213216 money of the Health and Human Services Office of Community
214217 Transportation Services are transferred to the Health and Human
215218 Services Commission.
216219 SECTION 11. This Act takes effect September 1, 2021.
