55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to access to certain law enforcement, corrections, and
88 prosecutorial records under the public information law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 552.108, Government Code, is amended by
1111 amending Subsection (c) and adding Subsections (d), (e), and (f) to
1212 read as follows:
1313 (c) This section does not except from the requirements of
1414 Section 552.021:
1515 (1) information that is basic information about an
1616 arrested person, an arrest, [or] a crime, or a criminal
1717 investigation; and
1818 (2) basic information contained in:
1919 (A) a search warrant;
2020 (B) testimony, an affidavit, or other
2121 information used to support a finding of probable cause to execute a
2222 search warrant;
2323 (C) an arrest warrant, an arrest report, an
2424 incident report, or an accident report;
2525 (D) a mug shot;
2626 (E) a report relating to:
2727 (i) an officer-involved shooting; or
2828 (ii) an incident involving the discharge of
2929 a firearm by a peace officer, including the unintentional discharge
3030 of a firearm in the course of duty or in response to a call,
3131 regardless of whether:
3232 (a) a person is hit by gunfire; or
3333 (b) an allegation of misconduct is
3434 made;
3535 (F) a report relating to a peace officer's use of
3636 force resulting in death or serious bodily injury as defined by
3737 Section 1.07, Penal Code; or
3838 (G) a report related to the death or serious
3939 bodily injury of an arrestee or detainee while the person is in the
4040 custodial care of a law enforcement agency.
4141 (d) The exceptions to disclosure provided by Subsections
4242 (a)(2) and (b)(2) do not apply to information, records, or
4343 notations if:
4444 (1) a person who is a subject of the information,
4545 record, or notation, other than a peace officer, is deceased or
4646 incapacitated; or
4747 (2) each person who is a subject of the information,
4848 record, or notation consents to the release of the information,
4949 record, or notation.
5050 (e) This section does not except from the requirements of
5151 Section 552.021 a letter, memorandum, or document regarding a peace
5252 officer's alleged misconduct in the peace officer's personnel file
5353 under Section 143.089, Local Government Code, if:
5454 (1) a person who is a subject of the letter,
5555 memorandum, or document, other than the peace officer, is deceased
5656 or incapacitated; or
5757 (2) each person who is a subject of the letter,
5858 memorandum, or document consents to the release of the letter,
5959 memorandum, or document.
6060 (f) A governmental body that releases information, records,
6161 or notations to a family member of a deceased or incapacitated
6262 person who is a subject of the information, record, or notation is
6363 not considered to have voluntarily made that information available
6464 to the public for purposes of Section 552.007 and does not waive the
6565 ability to assert in the future that the information is excepted
6666 from required disclosure under this section or other law.
6767 SECTION 2. Section 143.089, Local Government Code, is
6868 amended by amending Subsection (g) and adding Subsection (h) to
6969 read as follows:
7070 (g) A fire or police department may maintain a personnel
7171 file on a fire fighter or police officer employed by the department
7272 to store sensitive personal information, including the
7373 individual's home address, home telephone number, personal
7474 cellular telephone number, emergency contact information, social
7575 security number, personal financial information, information that
7676 reveals whether the person has family members, and any other
7777 personal information the disclosure of which would constitute a
7878 clearly unwarranted invasion of personal privacy. The [for the
7979 department's use, but the] department may not release any
8080 information contained in the department file to any agency or
8181 person requesting information relating to a fire fighter or police
8282 officer, other than information in a police officer's personnel
8383 file relating to a police officer's alleged misconduct, as
8484 permitted by Section 552.108, Government Code. The department
8585 shall refer to the director or the director's designee a person or
8686 agency that requests information that is maintained in the fire
8787 fighter's or police officer's personnel file.
8888 (h) Notwithstanding any other law, a fire or police
8989 department shall disclose law enforcement disciplinary record
9090 information reasonably necessary to identify an allegation against
9191 a fire fighter or police officer that resulted in a sustained
9292 finding of misconduct, including:
9393 (1) any record created in furtherance of a law
9494 enforcement disciplinary proceeding;
9595 (2) each complaint, allegation, and charge against the
9696 employee;
9797 (3) the name of the employee complained of or charged;
9898 (4) the transcript of any disciplinary trial or
9999 hearing, including any exhibit introduced at the trial or hearing;
100100 (5) the disposition of any disciplinary proceeding;
101101 and
102102 (6) the final written opinion or memorandum supporting
103103 the disposition and discipline imposed, including the agency's:
104104 (A) complete factual findings; and
105105 (B) analysis of the conduct and appropriate
106106 discipline of the covered employee.
107107 SECTION 3. The changes in law made by this Act apply to
108108 information produced or maintained before, on, or after the
109109 effective date of this Act.
110110 SECTION 4. This Act takes effect September 1, 2021.
