510 AN ACT
611 relating to legislative leave for certain peace officers
712 commissioned by the Parks and Wildlife Department.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
1015 Code, is amended by adding Section 11.0183 to read as follows:
1116 Sec. 11.0183. DONATION OF ACCRUED COMPENSATORY TIME OR
1217 ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The director
1318 shall allow a peace officer commissioned by the department to
1419 voluntarily transfer to a legislative leave pool up to eight hours
1520 of compensatory time or annual leave per year earned by the peace
1621 officer.
1722 (b) The director or the director's designee shall
1823 administer the legislative leave pool.
1924 (c) The commission shall adopt rules and prescribe
2025 procedures relating to the operation of the legislative leave pool.
2126 (d) The director or the director's designee shall credit the
2227 legislative leave pool with the amount of time contributed by a
2328 peace officer commissioned by the department and deduct a
2429 corresponding amount of time from the peace officer's earned
2530 compensatory time or annual leave as if the peace officer had used
2631 the time for personal purposes.
2732 (e) A peace officer commissioned by the department is
2833 entitled to use time contributed to the legislative leave pool if
2934 the peace officer uses the time for legislative leave on behalf of a
3035 law enforcement association:
3136 (1) related to the peace officer's employment with the
3237 department;
3338 (2) that has at least 300 active or retired members;
3439 and
3540 (3) that is governed by a board of directors.
3641 (f) The director or the director's designee shall transfer
3742 time from the pool to the peace officer and credit the time to the
3843 peace officer.
3944 (g) A peace officer commissioned by the department may only
4045 withdraw time from the legislative leave pool in coordination with
4146 and with the consent of the president or designee of the law
4247 enforcement association described in Subsection (e). A peace
4348 officer may not draw more than 80 hours from the pool in a 160-hour
4449 work cycle and may not draw more than 480 hours from the pool in a
4550 fiscal year.
4651 (h) A peace officer commissioned by the department shall use
4752 time from the legislative leave pool in accordance with rules
4853 adopted by the commission.
4954 SECTION 2. This Act takes effect September 1, 2021.
