| 8 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 14 | | SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
|---|
| 10 | 15 | | Code, is amended by adding Section 11.0183 to read as follows: |
|---|
| 11 | 16 | | Sec. 11.0183. DONATION OF ACCRUED COMPENSATORY TIME OR |
|---|
| 12 | 17 | | ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The director |
|---|
| 13 | 18 | | shall allow a peace officer commissioned by the department to |
|---|
| 14 | 19 | | voluntarily transfer to a legislative leave pool up to eight hours |
|---|
| 15 | 20 | | of compensatory time or annual leave per year earned by the peace |
|---|
| 16 | 21 | | officer. |
|---|
| 17 | 22 | | (b) The director or the director's designee shall |
|---|
| 18 | 23 | | administer the legislative leave pool. |
|---|
| 19 | 24 | | (c) The commission shall adopt rules and prescribe |
|---|
| 20 | 25 | | procedures relating to the operation of the legislative leave pool. |
|---|
| 21 | 26 | | (d) The director or the director's designee shall credit the |
|---|
| 22 | 27 | | legislative leave pool with the amount of time contributed by a |
|---|
| 23 | 28 | | peace officer commissioned by the department and deduct a |
|---|
| 24 | 29 | | corresponding amount of time from the peace officer's earned |
|---|
| 25 | 30 | | compensatory time or annual leave as if the peace officer had used |
|---|
| 26 | 31 | | the time for personal purposes. |
|---|
| 27 | 32 | | (e) A peace officer commissioned by the department is |
|---|
| 28 | 33 | | entitled to use time contributed to the legislative leave pool if |
|---|
| 29 | 34 | | the peace officer uses the time for legislative leave on behalf of a |
|---|
| 30 | 35 | | law enforcement association: |
|---|
| 31 | 36 | | (1) related to the peace officer's employment with the |
|---|
| 32 | 37 | | department; |
|---|
| 33 | 38 | | (2) that has at least 300 active or retired members; |
|---|
| 34 | 39 | | and |
|---|
| 35 | 40 | | (3) that is governed by a board of directors. |
|---|
| 36 | 41 | | (f) The director or the director's designee shall transfer |
|---|
| 37 | 42 | | time from the pool to the peace officer and credit the time to the |
|---|
| 38 | 43 | | peace officer. |
|---|
| 39 | 44 | | (g) A peace officer commissioned by the department may only |
|---|
| 40 | 45 | | withdraw time from the legislative leave pool in coordination with |
|---|
| 41 | 46 | | and with the consent of the president or designee of the law |
|---|
| 42 | 47 | | enforcement association described in Subsection (e). A peace |
|---|
| 43 | 48 | | officer may not draw more than 80 hours from the pool in a 160-hour |
|---|
| 44 | 49 | | work cycle and may not draw more than 480 hours from the pool in a |
|---|
| 45 | 50 | | fiscal year. |
|---|
| 46 | 51 | | (h) A peace officer commissioned by the department shall use |
|---|
| 47 | 52 | | time from the legislative leave pool in accordance with rules |
|---|
| 48 | 53 | | adopted by the commission. |
|---|
| 49 | 54 | | SECTION 2. This Act takes effect September 1, 2021. |
