66 AN ACT
77 relating to certain vendors entering into agreements with the
88 Department of Public Safety for the issuance of renewal and
99 duplicate driver's licenses and other identification certificate
1010 services, including voter registration services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 20.001, Election Code, is amended by
1313 adding Subsection (b-1) to read as follows:
1414 (b-1) Each vendor that provides services under an agreement
1515 described by Section 521.009, Transportation Code, is designated as
1616 a voter registration agency.
1717 SECTION 2. The heading to Subchapter C, Chapter 20,
1818 Election Code, is amended to read as follows:
1919 SUBCHAPTER C. DEPARTMENT OF PUBLIC SAFETY AND VENDORS
2020 SECTION 3. Section 20.061, Election Code, is amended to
2121 read as follows:
2222 Sec. 20.061. APPLICABILITY [OF OTHER PROVISIONS]. (a) The
2323 other provisions of this chapter apply to the Department of Public
2424 Safety and vendors described by Section 20.001(b-1) except
2525 provisions that conflict with this subchapter.
2626 (b) The provisions of this subchapter apply to vendors
2727 described by Section 20.001(b-1) in the same manner as those
2828 provisions apply to the Department of Public Safety.
2929 SECTION 4. Section 521.009, Transportation Code, is amended
3030 by amending Subsections (a), (a-1), and (c) and adding Subsections
3131 (e-1), (e-2), and (g) to read as follows:
3232 (a) The department may establish a program for the provision
3333 of renewal and duplicate driver's license, election identification
3434 certificate, and personal identification certificate services by
3535 [in] counties, [and] municipalities, and private vendors that enter
3636 into an agreement with the department under Subsection (a-1).
3737 (a-1) Under the program, the department may enter into an
3838 agreement with the commissioners court of a county, [or] the
3939 governing body of a municipality, or a private vendor, to permit
4040 county, [or] municipal, or vendor employees to provide services at
4141 a county or municipal office or at a location determined by the
4242 vendor relating to the issuance of renewal and duplicate driver's
4343 licenses, election identification certificates, and personal
4444 identification certificates, including:
4545 (1) taking photographs;
4646 (2) administering vision tests;
4747 (3) updating a driver's license, election
4848 identification certificate, or personal identification certificate
4949 to change a name, address, or photograph;
5050 (4) distributing and collecting information relating
5151 to donations under Section 521.401;
5252 (5) collecting fees; and
5353 (6) performing other basic ministerial functions and
5454 tasks necessary to issue renewal and duplicate driver's licenses,
5555 election identification certificates, and personal identification
5656 certificates.
5757 (c) A participating county, [or] municipality, or vendor
5858 must remit to the department for deposit as required by this chapter
5959 fees collected for the issuance of a renewal or duplicate driver's
6060 license or personal identification certificate.
6161 (e-1) An agreement under Subsection (a-1) with a vendor must
6262 require the vendor to:
6363 (1) comply with training requirements developed by the
6464 department under Subsection (e-2);
6565 (2) agree to serve as a voter registration agency in a
6666 manner that ensures compliance with federal law; and
6767 (3) comply with the same privacy and information
6868 security standards required of the department.
6969 (e-2) The department shall develop training requirements
7070 for a vendor relating to the services provided by the vendor under
7171 this section.
7272 (g) The department may perform periodic audits of a vendor
7373 that has entered into an agreement with the department under
7474 Subsection (a-1) to ensure compliance with this section, the
7575 agreement entered into under this section, and any rules adopted by
7676 the department under this section.
7777 SECTION 5. Section 521.428, Transportation Code, is amended
7878 to read as follows:
7979 Sec. 521.428. COUNTY, [OR] MUNICIPAL, OR PRIVATE VENDOR
8080 FEE. (a) A county, [or] municipality, or private vendor that
8181 provides services under an agreement described by Section 521.009
8282 may collect an additional fee of up to $10 [$5] for each transaction
8383 provided that relates to driver's license and personal
8484 identification certificate services only.
8585 (b) No portion of a fee authorized under this section may be
8686 charged for performing a function in connection with voter
8787 registration.
8888 SECTION 6. As soon as practicable after the effective date
8989 of this Act, the Department of Public Safety of the State of Texas
9090 shall adopt rules as necessary to implement Section 521.009,
9191 Transportation Code, as amended by this Act.
9292 SECTION 7. This Act takes effect September 1, 2021.
