8 | 8 | | Department of Public Safety for the issuance of renewal and |
---|
9 | 9 | | duplicate driver's licenses and other identification certificate |
---|
10 | 10 | | services, including voter registration services. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 20.001, Election Code, is amended by |
---|
13 | 13 | | adding Subsection (b-1) to read as follows: |
---|
14 | 14 | | (b-1) Each vendor that provides services under an agreement |
---|
15 | 15 | | described by Section 521.009, Transportation Code, is designated as |
---|
16 | 16 | | a voter registration agency. |
---|
17 | 17 | | SECTION 2. The heading to Subchapter C, Chapter 20, |
---|
18 | 18 | | Election Code, is amended to read as follows: |

19 | 19 | | SUBCHAPTER C. DEPARTMENT OF PUBLIC SAFETY AND VENDORS |
---|
20 | 20 | | SECTION 3. Section 20.061, Election Code, is amended to |
---|
21 | 21 | | read as follows: |
---|
22 | 22 | | Sec. 20.061. APPLICABILITY [OF OTHER PROVISIONS]. (a) The |
---|
23 | 23 | | other provisions of this chapter apply to the Department of Public |
---|
24 | 24 | | Safety and vendors described by Section 20.001(b-1) except |
---|
25 | 25 | | provisions that conflict with this subchapter. |
---|
26 | 26 | | (b) The provisions of this subchapter apply to vendors |
---|
27 | 27 | | described by Section 20.001(b-1) in the same manner as those |
---|
28 | 28 | | provisions apply to the Department of Public Safety. |
---|
29 | 29 | | SECTION 4. Section 521.009, Transportation Code, is amended |
---|
30 | 30 | | by amending Subsections (a), (a-1), and (c) and adding Subsections |
---|
31 | 31 | | (e-1), (e-2), and (g) to read as follows: |
---|
32 | 32 | | (a) The department may establish a program for the provision |
---|
33 | 33 | | of renewal and duplicate driver's license, election identification |
---|
34 | 34 | | certificate, and personal identification certificate services by |
---|
35 | 35 | | [in] counties, [and] municipalities, and private vendors that enter |
---|
36 | 36 | | into an agreement with the department under Subsection (a-1). |
---|
37 | 37 | | (a-1) Under the program, the department may enter into an |
---|
38 | 38 | | agreement with the commissioners court of a county, [or] the |
---|
39 | 39 | | governing body of a municipality, or a private vendor, to permit |
---|
40 | 40 | | county, [or] municipal, or vendor employees to provide services at |
---|
41 | 41 | | a county or municipal office or at a location determined by the |
---|
42 | 42 | | vendor relating to the issuance of renewal and duplicate driver's |
---|
43 | 43 | | licenses, election identification certificates, and personal |
---|
44 | 44 | | identification certificates, including: |
---|
45 | 45 | | (1) taking photographs; |
---|
46 | 46 | | (2) administering vision tests; |
---|
47 | 47 | | (3) updating a driver's license, election |
---|
48 | 48 | | identification certificate, or personal identification certificate |
---|
49 | 49 | | to change a name, address, or photograph; |
---|
50 | 50 | | (4) distributing and collecting information relating |
---|
51 | 51 | | to donations under Section 521.401; |
---|
52 | 52 | | (5) collecting fees; and |
---|
53 | 53 | | (6) performing other basic ministerial functions and |
---|
54 | 54 | | tasks necessary to issue renewal and duplicate driver's licenses, |
---|
55 | 55 | | election identification certificates, and personal identification |
---|
56 | 56 | | certificates. |
---|
57 | 57 | | (c) A participating county, [or] municipality, or vendor |
---|
58 | 58 | | must remit to the department for deposit as required by this chapter |
---|
59 | 59 | | fees collected for the issuance of a renewal or duplicate driver's |
---|
60 | 60 | | license or personal identification certificate. |
---|
61 | 61 | | (e-1) An agreement under Subsection (a-1) with a vendor must |
---|
62 | 62 | | require the vendor to: |
---|
63 | 63 | | (1) comply with training requirements developed by the |
---|
64 | 64 | | department under Subsection (e-2); |
---|
65 | 65 | | (2) agree to serve as a voter registration agency in a |
---|
66 | 66 | | manner that ensures compliance with federal law; and |
---|
67 | 67 | | (3) comply with the same privacy and information |
---|
68 | 68 | | security standards required of the department. |
---|
69 | 69 | | (e-2) The department shall develop training requirements |
---|
70 | 70 | | for a vendor relating to the services provided by the vendor under |
---|
71 | 71 | | this section. |
---|
72 | 72 | | (g) The department may perform periodic audits of a vendor |
---|
73 | 73 | | that has entered into an agreement with the department under |
---|
74 | 74 | | Subsection (a-1) to ensure compliance with this section, the |
---|
75 | 75 | | agreement entered into under this section, and any rules adopted by |
---|
76 | 76 | | the department under this section. |
---|
77 | 77 | | SECTION 5. Section 521.428, Transportation Code, is amended |
---|
78 | 78 | | to read as follows: |
---|
79 | 79 | | Sec. 521.428. COUNTY, [OR] MUNICIPAL, OR PRIVATE VENDOR |
---|
80 | 80 | | FEE. (a) A county, [or] municipality, or private vendor that |
---|
81 | 81 | | provides services under an agreement described by Section 521.009 |
---|
82 | 82 | | may collect an additional fee of up to $10 [$5] for each transaction |
---|
83 | 83 | | provided that relates to driver's license and personal |
---|
84 | 84 | | identification certificate services only. |
---|
85 | 85 | | (b) No portion of a fee authorized under this section may be |
---|
86 | 86 | | charged for performing a function in connection with voter |
---|
87 | 87 | | registration. |
---|
88 | 88 | | SECTION 6. As soon as practicable after the effective date |
---|
89 | 89 | | of this Act, the Department of Public Safety of the State of Texas |
---|
90 | 90 | | shall adopt rules as necessary to implement Section 521.009, |
---|
91 | 91 | | Transportation Code, as amended by this Act. |
---|
92 | 92 | | SECTION 7. This Act takes effect September 1, 2021. |
