44 SENATE CONCURRENT RESOLUTION
55 WHEREAS, The United States Census Bureau announced on April
66 26, 2021, that the 2020 Census shows the population of the United
77 States on April 1, 2020 was 331,449,281, an increase of 22,703,743
88 people or 7.4% from the population total in 2010; and
99 WHEREAS, The United States Census Bureau announced that
1010 Texas' population on April 1, 2020 was 29,183,290; and
1111 WHEREAS, The United States Census Bureau also apportioned
1212 United States Representatives among the several states pursuant to
1313 Article 1, Section 2, of the United States Constitution; and
1414 WHEREAS, Texas received two additional congressional
1515 representatives bringing its total Texas delegation to the U.S.
1616 House of Representatives to 38; and
1717 WHEREAS, Texas narrowly missed out on being allocated a third
1818 new congressional representative, the Texas 39th congressional
1919 district, which ranked 438th out of 435 possible congressional
2020 seats; and
2121 WHEREAS, Experts like the Texas State Demographer, Dr. Lloyd
2222 Potter, have raised concerns that the 2020 Census for Texas is
2323 likely to have a substantial undercount, meaning that the actual
2424 enumeration of Texans is likely to be more than the census reported
2525 population of the State; and
2626 WHEREAS, Texas has some of the most difficult populations in
2727 the United States to count due to its geographic size, language and
2828 ethnic diversity, and other socio-economic factors; and
2929 WHEREAS, An undercount of less than 1% in the Texas Census
3030 population would yield enough new population that Texas would
3131 likely merit another congressional representative if its true
3232 population on April 1, 2020 were known; and
3333 WHEREAS, An undercount of 1% will cost Texas $300,000,000
3434 dollars in federal funding per year; now, therefore, be it
3535 RESOLVED, That the of the 87th Texas Legislature of the State
3636 of Texas hereby authorizes the Attorney General of Texas to seek all
3737 necessary relief, including seeking an adjustment to the U.S.
3838 Census in order that the true nature of the Texas population may be
3939 known and congressional representation may be reapportioned so that
4040 justice may be done.
