55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring the state to expand
77 eligibility for Medicaid to certain persons under the federal
88 Patient Protection and Affordable Care Act.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article XVI, Texas Constitution, is amended by
1111 adding Section 74 to read as follows:
1212 Sec. 74. The state shall provide medical assistance to all
1313 persons who apply for that assistance and for whom federal matching
1414 funds are available under the Patient Protection and Affordable
1515 Care Act (Pub. L. No. 111-148), as amended by the Health Care and
1616 Education Reconciliation Act of 2010 (Pub. L. No. 111-152), to the
1717 state to provide that assistance.
1818 SECTION 2. The following temporary provision is added to
1919 the Texas Constitution:
2020 TEMPORARY PROVISION. (a) This temporary provision applies
2121 to the constitutional amendment proposed by the 87th Legislature,
2222 Regular Session, 2021, requiring the state to expand eligibility
2323 for Medicaid to all persons for whom federal matching funds are
2424 available under the federal Patient Protection and Affordable Care
2525 Act.
2626 (b) Section 74, Article XVI, of this constitution takes
2727 effect January 1, 2022.
2828 (c) This temporary provision expires January 1, 2023.
2929 SECTION 3. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 2, 2021.
3131 The ballot shall be printed to provide for voting for or against the
3232 proposition: "The constitutional amendment requiring the state to
3333 expand eligibility for Medicaid to all persons for whom federal
3434 matching funds are available under the federal Patient Protection
3535 and Affordable Care Act."
