55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the commissioners
77 court of a county to adopt an exemption from ad valorem taxation by
88 the county of a portion, expressed as a dollar amount, of the
99 appraised value of an individual's residence homestead.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1-b, Article VIII, Texas Constitution,
1212 is amended by adding Subsection (v) to read as follows:
1313 (v) The commissioners court of a county by official action
1414 may exempt from ad valorem taxation by the county a portion,
1515 expressed as a dollar amount, of the appraised value of the
1616 residence homestead of an individual. The amount of the exemption
1717 may not exceed $100,000. An eligible individual is entitled to
1818 receive other applicable exemptions provided by law. Where ad
1919 valorem tax has previously been pledged for the payment of debt, the
2020 county may continue to levy and collect the tax against the value of
2121 the homesteads exempted under this subsection until the debt is
2222 discharged if the cessation of the levy would impair the obligation
2323 of the contract by which the debt was created.
2424 SECTION 2. The following temporary provision is added to
2525 the Texas Constitution:
2626 TEMPORARY PROVISION. (a) This temporary provision applies
2727 to the constitutional amendment proposed by the 87th Legislature,
2828 Regular Session, 2021, authorizing the commissioners court of a
2929 county to adopt an exemption from ad valorem taxation by the county
3030 of a portion, expressed as a dollar amount, of the appraised value
3131 of an individual's residence homestead.
3232 (b) The amendment to Section 1-b, Article VIII, of this
3333 constitution takes effect beginning with the tax year that begins
3434 January 1, 2022.
3535 (c) This temporary provision expires January 1, 2023.
3636 SECTION 3. This proposed constitutional amendment shall be
3737 submitted to the voters at an election to be held November 2, 2021.
3838 The ballot shall be printed to permit voting for or against the
3939 proposition: "The constitutional amendment authorizing the
4040 commissioners court of a county to adopt an exemption from ad
4141 valorem taxation by the county of a portion, expressed as a dollar
4242 amount, of the appraised value of an individual's residence
4343 homestead."
