8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article I, Texas Constitution, is amended by | |
10 | 10 | adding Section 36 to read as follows: | |
11 | 11 | Sec. 36. (a) A patient of a hospital, as those terms are | |
12 | 12 | defined by general law, has the right to designate at least one | |
13 | 13 | essential caregiver with whom the hospital may not prohibit | |
14 | 14 | in-person visitation. | |
15 | 15 | (b) The legislature by general law may provide for | |
16 | 16 | guidelines for a hospital described by Subsection (a) of this | |
17 | 17 | section to follow in establishing essential caregiver visitation | |
18 | 18 | policies and procedures. | |
19 | 19 | SECTION 2. This proposed constitutional amendment shall be | |
20 | 20 | submitted to the voters at an election to be held November 2, 2021. | |
21 | 21 | The ballot shall be printed to permit voting for or against the | |
22 | 22 | proposition: " The constitutional amendment establishing a right | |
23 | 23 | for hospital patients to designate an essential caregiver for | |
24 | 24 | in-person visitation." |
