44 SENATE JOINT RESOLUTION
55 proposing a constitutional amendment establishing a right for
66 hospital patients to designate an essential caregiver for in-person

88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article I, Texas Constitution, is amended by
1010 adding Section 36 to read as follows:
1111 Sec. 36. (a) A patient of a hospital, as those terms are
1212 defined by general law, has the right to designate at least one
1313 essential caregiver with whom the hospital may not prohibit
1414 in-person visitation.
1515 (b) The legislature by general law may provide for
1616 guidelines for a hospital described by Subsection (a) of this
1717 section to follow in establishing essential caregiver visitation
1818 policies and procedures.
1919 SECTION 2. This proposed constitutional amendment shall be
2020 submitted to the voters at an election to be held November 2, 2021.
2121 The ballot shall be printed to permit voting for or against the
2222 proposition: " The constitutional amendment establishing a right
2323 for hospital patients to designate an essential caregiver for
2424 in-person visitation."
