55 A JOINT RESOLUTION
66 proposing a constitutional amendment to authorize the legislature
77 to review and terminate an order issued by the governor during a
88 state of disaster or emergency declared by the governor.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article III, Texas Constitution, is amended by
1111 adding Section 42 to read as follows:
1212 Sec. 42. (a) Notwithstanding Section 40 of this article,
1313 the legislature may review and terminate during a regular or
1414 special session an order issued by the governor during a state of
1515 disaster or emergency declared by the governor. The legislature may
1616 terminate the order by passage of a resolution approved by a
1717 majority vote of the members present in each house of the
1818 legislature.
1919 (b) A vote under Subsection (a) of this section is not
2020 subject to Section 15, Article IV, of this constitution.
2121 SECTION 2. This proposed constitutional amendment shall be
2222 submitted to the voters at an election to be held November 2, 2021.
2323 The ballot shall be printed to permit voting for or against the
2424 proposition: "The constitutional amendment to authorize the
2525 legislature to review and terminate an order issued by the governor
2626 during a state of disaster or emergency declared by the governor."
