9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article III, Texas Constitution, is amended by | |
11 | 11 | adding Section 42 to read as follows: | |
12 | 12 | Sec. 42. (a) Notwithstanding Section 40 of this article, | |
13 | 13 | the legislature may review and terminate during a regular or | |
14 | 14 | special session an order issued by the governor during a state of | |
15 | 15 | disaster or emergency declared by the governor. The legislature may | |
16 | 16 | terminate the order by passage of a resolution approved by a | |
17 | 17 | majority vote of the members present in each house of the | |
18 | 18 | legislature. | |
19 | 19 | (b) A vote under Subsection (a) of this section is not | |
20 | 20 | subject to Section 15, Article IV, of this constitution. | |
21 | 21 | SECTION 2. This proposed constitutional amendment shall be | |
22 | 22 | submitted to the voters at an election to be held November 2, 2021. | |
23 | 23 | The ballot shall be printed to permit voting for or against the | |
24 | 24 | proposition: "The constitutional amendment to authorize the | |
25 | 25 | legislature to review and terminate an order issued by the governor | |
26 | 26 | during a state of disaster or emergency declared by the governor." |
