| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article XVI, Texas Constitution, is amended by |
|---|
| 10 | 10 | | adding Section 74 to read as follows: |
|---|
| 11 | 11 | | Sec. 74. The state, acting under the exemption provisions |
|---|
| 12 | 12 | | of Section 3(a), Uniform Time Act of 1966 (15 U.S.C. Section |
|---|
| 13 | 13 | | 260a(a)), is exempt from the provisions of that law that establish |
|---|
| 14 | 14 | | daylight saving time. The exemption provided by this section |
|---|
| 15 | 15 | | applies to both the portion of the state using central standard time |
|---|
| 16 | 16 | | as the official standard time and the portion of the state using |
|---|
| 17 | 17 | | mountain standard time as the official standard time. |
|---|
| 18 | 18 | | SECTION 2. The following temporary provision is added to |
|---|
| 19 | 19 | | the Texas Constitution: |
|---|
| 20 | 20 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 21 | 21 | | to the constitutional amendment proposed by the 87th Legislature, |
|---|
| 22 | 22 | | Regular Session, 2021, exempting this state from the provisions of |
|---|
| 23 | 23 | | federal law that establish daylight saving time. |
|---|
| 24 | 24 | | (b) The constitutional amendment takes effect March 1, |
|---|
| 25 | 25 | | 2022. |
|---|
| 26 | 26 | | (c) This temporary provision takes effect on the adoption of |
|---|
| 27 | 27 | | the constitutional amendment by the voters and expires September 1, |
|---|
| 28 | 28 | | 2022. |
|---|
| 29 | 29 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 30 | 30 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 31 | 31 | | The ballot shall be printed to permit voting for or against the |
|---|
| 32 | 32 | | proposition: "The constitutional amendment exempting this state |
|---|
| 33 | 33 | | from daylight saving time." |
