5	5	BE IT RESOLVED by the Senate of the State of Texas, 87th
6	6	Legislature, Regular Session, 2021, That Senate Rule 12.03 be
7	7	suspended in part as provided by Senate Rule 12.08 to enable the
8	8	conference committee appointed to resolve the differences on
9	9	Senate Bill 3 (preparing for, preventing, and responding to
10	10	weather emergencies and power outages; increasing the amount of
11	11	administrative and civil penalties) to consider and take action
12	12	on the following matter:
13	13	(1) Senate Rule 12.03(2) is suspended to permit the
14	14	committee to omit text not in disagreement by omitting proposed
15	15	Sections 39.110(a) and (b), Utilities Code. The omitted text
16	16	prohibited the offering of certain wholesale indexed electric
17	17	products to residential or small commercial customers. The
18	18	omitted text reads:
19	19	Sec. 39.110. WHOLESALE INDEXED PRODUCTS PROHIBITED. (a)
20	20	In this section, "wholesale indexed product" means a retail
21	21	electric product in which the price a customer pays for
22	22	electricity includes a direct pass-through of real-time
23	23	settlement point prices determined by the independent
24	24	organization certified under Section 39.151 for the ERCOT power
25	25	region.
26	26	(b) A retail electric provider may not offer a wholesale
27	27	indexed product to a residential or small commercial customer.
28	28	Sec. 39.110. WHOLESALE INDEXED PRODUCTS. (a) In this
29	29	section, "wholesale indexed product" means a retail electric
30	30	product in which the price a customer pays for electricity
31	31	includes a direct pass-through of real-time settlement point
32	32	prices determined by the independent organization certified
33	33	under Section 39.151 for the ERCOT power region.
34	34	(b) Except as provided by Subsection (c), an aggregator,
35	35	a broker, or a retail electric provider may not offer a wholesale
36	36	indexed product to a residential or small commercial customer.
37	37	Explanation: The omission of the text is necessary to
38	38	remove the prohibition of the offering of certain wholesale
39	39	indexed electric products to residential or small commercial
40	40	customers.
41	41	(2) Senate Rule 12.03(4) is suspended to permit the
42	42	committee to add text on a matter not included in either the house
43	43	or senate version of the bill by adding proposed SECTION 37 of the
44	44	bill:
45	45	SECTION 37. The Texas Electricity Supply Chain Security
46	46	and Mapping Committee shall produce the map required under
47	47	Section 38.203, Utilities Code, as added by this Act, not later
48	48	than September 1, 2022.
49	49	Explanation: The addition of the text is necessary to
50	50	require the Texas Electricity Supply Chain Security and Mapping
51	51	Committee to produce the map required under added Section 38.203,
52	52	Utilities Code, not later than September 1, 2022.
