44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 87th
66 Legislature, Regular Session, 2021, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill 3 (preparing for, preventing, and responding to
1010 weather emergencies and power outages; increasing the amount of
1111 administrative and civil penalties) to consider and take action
1212 on the following matter:
1313 (1) Senate Rule 12.03(2) is suspended to permit the
1414 committee to omit text not in disagreement by omitting proposed
1515 Sections 39.110(a) and (b), Utilities Code. The omitted text
1616 prohibited the offering of certain wholesale indexed electric
1717 products to residential or small commercial customers. The
1818 omitted text reads:
1919 Sec. 39.110. WHOLESALE INDEXED PRODUCTS PROHIBITED. (a)
2020 In this section, "wholesale indexed product" means a retail
2121 electric product in which the price a customer pays for
2222 electricity includes a direct pass-through of real-time
2323 settlement point prices determined by the independent
2424 organization certified under Section 39.151 for the ERCOT power
2525 region.
2626 (b) A retail electric provider may not offer a wholesale
2727 indexed product to a residential or small commercial customer.
2828 Sec. 39.110. WHOLESALE INDEXED PRODUCTS. (a) In this
2929 section, "wholesale indexed product" means a retail electric
3030 product in which the price a customer pays for electricity
3131 includes a direct pass-through of real-time settlement point
3232 prices determined by the independent organization certified
3333 under Section 39.151 for the ERCOT power region.
3434 (b) Except as provided by Subsection (c), an aggregator,
3535 a broker, or a retail electric provider may not offer a wholesale
3636 indexed product to a residential or small commercial customer.
3737 Explanation: The omission of the text is necessary to
3838 remove the prohibition of the offering of certain wholesale
3939 indexed electric products to residential or small commercial
4040 customers.
4141 (2) Senate Rule 12.03(4) is suspended to permit the
4242 committee to add text on a matter not included in either the house
4343 or senate version of the bill by adding proposed SECTION 37 of the
4444 bill:
4545 SECTION 37. The Texas Electricity Supply Chain Security
4646 and Mapping Committee shall produce the map required under
4747 Section 38.203, Utilities Code, as added by this Act, not later
4848 than September 1, 2022.
4949 Explanation: The addition of the text is necessary to
5050 require the Texas Electricity Supply Chain Security and Mapping
5151 Committee to produce the map required under added Section 38.203,
5252 Utilities Code, not later than September 1, 2022.
