5	5	AN ACT
6	6	relating to the expiration date of driver's licenses and renewal
7	7	driver's licenses issued to noncitizens.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Subchapter M, Chapter 521, Transportation Code,
10	10	is amended by adding Section 521.2712 to read as follows:
11	11	Sec. 521.2712. EXPIRATION OF NONCITIZEN LICENSE AND
12	12	RENEWAL. (a) Except as provided by Subsection (b), each original
13	13	driver's license issued to an applicant who is not a citizen and
14	14	each renewal of those licenses expires on the earliest of:
15	15	(1) the first anniversary of the date of issuance or
16	16	renewal, as applicable;
17	17	(2) the expiration date of the applicant's or license
18	18	holder's lawful presence in the United States as determined by the
19	19	appropriate United States agency in compliance with federal law, if
20	20	there is a definite expiration date for the applicant's or license
21	21	holder's authorized stay in the United States; or
22	22	(3) another date applicable under this subchapter,
23	23	including the date of a court order under Section 521.271(a)(4).
24	24	(b) Each original provisional or learner license issued to a
25	25	person who is not a citizen and each renewal of those licenses
26	26	expires on the earliest of:
27	27	(1) the first anniversary of the date of issuance or
28	28	renewal, as applicable;
29	29	(2) the 18th birthday of the license holder; or
30	30	(3) the expiration of the applicant's or license
31	31	holder's lawful presence in the United States as determined by the
32	32	appropriate United States agency in compliance with federal law, if
33	33	there is a definite expiration date for the applicant's or license
34	34	holder's authorized stay in the United States.
35	35	SECTION 2. Sections 521.271(a) and (b), Transportation
36	36	Code, are amended to read as follows:
37	37	(a) Except as provided by this subchapter, including
38	38	Sections 521.2711 and 521.2712, each [Each] original driver's
39	39	license, provisional license, learner license, or occupational
40	40	driver's license [issued to an applicant who is a citizen,
41	41	national, or legal permanent resident of the United States or a
42	42	refugee or asylee lawfully admitted into the United States] expires
43	43	as follows:
44	44	(1) [except as provided by Section 521.2711,] a
45	45	driver's license expires on the first birthday of the license
46	46	holder occurring after the eighth anniversary of the date of the
47	47	application;
48	48	(2) a provisional license expires on the 18th birthday
49	49	of the license holder;
50	50	(3) a learner license expires on the 18th birthday of
51	51	the license holder;
52	52	(4) an occupational driver's license expires on the
53	53	first anniversary of the court order granting the license; and
54	54	(5) unless an earlier date is otherwise provided, a
55	55	driver's license issued to a person whose residence or domicile is a
56	56	correctional facility or a parole facility expires on the first
57	57	birthday of the license holder occurring after the first
58	58	anniversary of the date of issuance.
59	59	(b) Except as otherwise provided by this subchapter,
60	60	including Sections [Section] 521.2711 and 521.2712, a driver's
61	61	license that is renewed expires on the earlier of:
62	62	(1) the eighth anniversary of the expiration date
63	63	before renewal if the applicant is a citizen, national, or legal
64	64	permanent resident of the United States or a refugee or asylee
65	65	lawfully admitted into the United States;
66	66	[(1-a) for an applicant not described by Subdivision
67	67	(1):
68	68	[(A) the earlier of:
69	69	[(i) the eighth anniversary of the
70	70	expiration date before renewal; or
71	71	[(ii) the expiration date of the
72	72	applicant's authorized stay in the United States; or
73	73	[(B) the first anniversary of the date of
74	74	issuance, if there is no definite expiration date for the
75	75	applicant's authorized stay in the United States;] or
76	76	(2) for a renewal driver's license issued to a person
77	77	whose residence or domicile is a correctional facility or a parole
78	78	facility, the first birthday of the license holder occurring after
79	79	the first anniversary of the date of issuance unless an earlier date
80	80	is otherwise provided.
81	81	SECTION 3. Section 521.272(c), Transportation Code, is
82	82	amended to read as follows:
83	83	(c) Notwithstanding Sections 521.271 and 521.2711, a
84	84	driver's license issued under this section, including a renewal,
85	85	duplicate, or corrected license, expires[:
86	86	[(1) if the license holder is a citizen, national, or
87	87	legal permanent resident of the United States or a refugee or asylee
88	88	lawfully admitted into the United States,] on the first birthday of
89	89	the license holder occurring after the date of application, except
90	90	that:
91	91	(1) [(A)] the initial license issued under this
92	92	section expires on the second birthday of the license holder
93	93	occurring after the date of application, subject to Subdivision (2)
94	94	[Paragraph (B)]; and
95	95	(2) [(B)] a license issued under this section to a
96	96	person described by Article 62.2021, Code of Criminal Procedure,
97	97	expires on the sixth anniversary of the date on which the license
98	98	was issued[; or
99	99	[(2) if the applicant is not described by Subdivision
100	100	(1), on the earlier of:
101	101	[(A) the expiration date of the applicant's
102	102	authorized stay in the United States; or
103	103	[(B) as applicable:
104	104	[(i) the first birthday of the license
105	105	holder occurring after the date of application;
106	106	[(ii) if the license holder holds an
107	107	initial license issued under this section, the second birthday of
108	108	the license holder occurring after the date of application; or
109	109	[(iii) if the license holder is a person
110	110	described by Article 62.2021, Code of Criminal Procedure, the sixth
111	111	anniversary of the date on which the license was issued].
112	112	SECTION 4. The following provisions of the Transportation
113	113	Code are repealed:
114	114	(1) Sections 521.271(a-2), (a-3), and (a-4); and
115	115	(2) Section 521.2711(c).
116	116	SECTION 5. The changes in law made by this Act apply only to
117	117	a driver's license issued or renewed on or after June 1, 2022. A
118	118	driver's license issued or renewed before June 1, 2022, is governed
119	119	by the law in effect immediately before the effective date of this
120	120	Act, and the former law is continued in effect for that purpose.
121	121	SECTION 6. This Act takes effect on the 91st day after the
122	122	last day of the legislative session.
