55 AN ACT
66 relating to the expiration date of driver's licenses and renewal
77 driver's licenses issued to noncitizens.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter M, Chapter 521, Transportation Code,
1010 is amended by adding Section 521.2712 to read as follows:
1111 Sec. 521.2712. EXPIRATION OF NONCITIZEN LICENSE AND
1212 RENEWAL. (a) Except as provided by Subsection (b), each original
1313 driver's license issued to an applicant who is not a citizen and
1414 each renewal of those licenses expires on the earliest of:
1515 (1) the first anniversary of the date of issuance or
1616 renewal, as applicable;
1717 (2) the expiration date of the applicant's or license
1818 holder's lawful presence in the United States as determined by the
1919 appropriate United States agency in compliance with federal law, if
2020 there is a definite expiration date for the applicant's or license
2121 holder's authorized stay in the United States; or
2222 (3) another date applicable under this subchapter,
2323 including the date of a court order under Section 521.271(a)(4).
2424 (b) Each original provisional or learner license issued to a
2525 person who is not a citizen and each renewal of those licenses
2626 expires on the earliest of:
2727 (1) the first anniversary of the date of issuance or
2828 renewal, as applicable;
2929 (2) the 18th birthday of the license holder; or
3030 (3) the expiration of the applicant's or license
3131 holder's lawful presence in the United States as determined by the
3232 appropriate United States agency in compliance with federal law, if
3333 there is a definite expiration date for the applicant's or license
3434 holder's authorized stay in the United States.
3535 SECTION 2. Sections 521.271(a) and (b), Transportation
3636 Code, are amended to read as follows:
3737 (a) Except as provided by this subchapter, including
3838 Sections 521.2711 and 521.2712, each [Each] original driver's
3939 license, provisional license, learner license, or occupational
4040 driver's license [issued to an applicant who is a citizen,
4141 national, or legal permanent resident of the United States or a
4242 refugee or asylee lawfully admitted into the United States] expires
4343 as follows:
4444 (1) [except as provided by Section 521.2711,] a
4545 driver's license expires on the first birthday of the license
4646 holder occurring after the eighth anniversary of the date of the
4747 application;
4848 (2) a provisional license expires on the 18th birthday
4949 of the license holder;
5050 (3) a learner license expires on the 18th birthday of
5151 the license holder;
5252 (4) an occupational driver's license expires on the
5353 first anniversary of the court order granting the license; and
5454 (5) unless an earlier date is otherwise provided, a
5555 driver's license issued to a person whose residence or domicile is a
5656 correctional facility or a parole facility expires on the first
5757 birthday of the license holder occurring after the first
5858 anniversary of the date of issuance.
5959 (b) Except as otherwise provided by this subchapter,
6060 including Sections [Section] 521.2711 and 521.2712, a driver's
6161 license that is renewed expires on the earlier of:
6262 (1) the eighth anniversary of the expiration date
6363 before renewal if the applicant is a citizen, national, or legal
6464 permanent resident of the United States or a refugee or asylee
6565 lawfully admitted into the United States;
6666 [(1-a) for an applicant not described by Subdivision
6767 (1):
6868 [(A) the earlier of:
6969 [(i) the eighth anniversary of the
7070 expiration date before renewal; or
7171 [(ii) the expiration date of the
7272 applicant's authorized stay in the United States; or
7373 [(B) the first anniversary of the date of
7474 issuance, if there is no definite expiration date for the
7575 applicant's authorized stay in the United States;] or
7676 (2) for a renewal driver's license issued to a person
7777 whose residence or domicile is a correctional facility or a parole
7878 facility, the first birthday of the license holder occurring after
7979 the first anniversary of the date of issuance unless an earlier date
8080 is otherwise provided.
8181 SECTION 3. Section 521.272(c), Transportation Code, is
8282 amended to read as follows:
8383 (c) Notwithstanding Sections 521.271 and 521.2711, a
8484 driver's license issued under this section, including a renewal,
8585 duplicate, or corrected license, expires[:
8686 [(1) if the license holder is a citizen, national, or
8787 legal permanent resident of the United States or a refugee or asylee
8888 lawfully admitted into the United States,] on the first birthday of
8989 the license holder occurring after the date of application, except
9090 that:
9191 (1) [(A)] the initial license issued under this
9292 section expires on the second birthday of the license holder
9393 occurring after the date of application, subject to Subdivision (2)
9494 [Paragraph (B)]; and
9595 (2) [(B)] a license issued under this section to a
9696 person described by Article 62.2021, Code of Criminal Procedure,
9797 expires on the sixth anniversary of the date on which the license
9898 was issued[; or
9999 [(2) if the applicant is not described by Subdivision
100100 (1), on the earlier of:
101101 [(A) the expiration date of the applicant's
102102 authorized stay in the United States; or
103103 [(B) as applicable:
104104 [(i) the first birthday of the license
105105 holder occurring after the date of application;
106106 [(ii) if the license holder holds an
107107 initial license issued under this section, the second birthday of
108108 the license holder occurring after the date of application; or
109109 [(iii) if the license holder is a person
110110 described by Article 62.2021, Code of Criminal Procedure, the sixth
111111 anniversary of the date on which the license was issued].
112112 SECTION 4. The following provisions of the Transportation
113113 Code are repealed:
114114 (1) Sections 521.271(a-2), (a-3), and (a-4); and
115115 (2) Section 521.2711(c).
116116 SECTION 5. The changes in law made by this Act apply only to
117117 a driver's license issued or renewed on or after June 1, 2022. A
118118 driver's license issued or renewed before June 1, 2022, is governed
119119 by the law in effect immediately before the effective date of this
120120 Act, and the former law is continued in effect for that purpose.
121121 SECTION 6. This Act takes effect on the 91st day after the
122122 last day of the legislative session.
